? INSTRUCTION TO BIDDERS A. PROJECT SPECIFICATIONS The City of North Olmsted, Ohio is seeking bids for ONE (1) NEW TRIM AND SURROUND FLEX DECK MOWER for the North Olmsted Springvale Golf Course as per the Specification that are part of the bid form. B. SEALED BIDS Bids shall be submitted in a sealed envelope clearly labeled, (Bid: ONE (1) NEW TRIM AND SURROUND FLEX DECK MOWER)to the City of North Olmsted Administration Building, 5200 Dover Center Road, North Olmsted, Ohio 44070, no later than 11:30 A.M., Eastern Standard Time, on . Bids received after this time will not be considered and will be returned unopened. No oral or telephone bids will be accepted. C. BID DOCUMENTS The bidding documents consist of all items on the Table of Contents and any addendum's issued by the City. Requirements found in any one item apply to the work as if referenced in other items. Complete set of bidding documents must be used in preparing bids. The City does not assume any responsibility for errors or misinterpretations resulting from the use of incomplete sets of bidding documents. The failure of omission of any bidder to receive or examine any documents or parts thereof, shail in no way relieve any bidder from any obligation with respect to his bid. Bids shall be signed with the name printed or typed below the signature. If the bidder is a corporation, the bid shall be signed with the legal name of the corporation, followed by the legal signature of an officer authorized to bind the corporation to a contract. If other than a President or Vice President signs the bid, a copy of authorization from the Board of Directors shall be attached. D. REJECTION OR ACCEPTANCE OF BID The City of North Olmsted reserves the right to reject any or all bids, and any part of any bid, and, also the right to waive any informalities in the bid. In awarding a contract, the City reserves the right to consider in addition to price and discount, all elements entering into the question of determining the ability of the bidder to perform the contract satisfactorily. All materials presented as a`substitute' should be entered on the proposal substitution sheet. Acceptance of tbe proposal of any bidder by the City shall not constitute an agreement between the City and such bidder and shall not be binding upon the City unless and until an agreement covering all conditions and provisions of the work to be performed by the successful bidder has, at the time of/or after the acceptance of such proposal, been reduced to writing and executed by both the City and the successful bidder. 2
