E. METHOD OF MAKING AWARD u? The total cost, quality, type of equipment, capabilities and reliability, available training support, quality of available technical service support and the degree and quality of dates and administrative support available, will be considered in determining which proposal is most advantageous to the City and therefore the most responsive and responsible bid. The City reserves the right to reject any and all bids and also the right to waive any informalities in the bid. F. DATE OF AWARD The City will award or reject all bids at its next regular meeting following the opening of the bid, or after notification to all bidders, postpone action until a later meeting. In any event, bidder will guarantee bid price for sixty (60) days from the date of bid opening. The successful bidder will be notified, by letter mailed to the address shown on the bid, that his bid has been accepted and that he has been awarded the contract. G. CANCELLATION OF AWARD The Service Director reserves the right to rescind the award of any Contract at any time before the execution of said contract by all parties without any liability to the City. H. EXECUTION OF CONTRACT The contract shall be signed by the successful bidder and returned, together with the required contract documents, within ten (10) days after the bidder has received notice that the contract has been awarded. No proposal shall be considered binding upon the City of North Olmsted until the execution of the contract. FAILURE TO EXECUTE CONTRACT Failure to execute the contract and file an acceptable bond shall be just cause for the cancellation of the award and the forfeiture of the proposal guaranty which shall become the property of the City, not made as a penalty, but in liquidation of damages sustained. Award may be made to the next most responsive and responsible bidder or the project may be advertised as the Service Director may decide. J. COMPETENCY OF BIDDER The opening and reading of the Proposal shall not be construed as an acceptance of the bidder as a qualified, responsible bidder. The City reserves the right to determine the competence and responsibility of a bidder from its knowledge of the bidder's qualifications or from other sources. In the event that the City shall require additional supporting data regarding the qualifications of the Bidder in order to determine whether he is a qualified, responsible Bidder, the Bidder may be required to furnish any or ail of the following information: A. Evidence that the Bidder is capable of commencing performance as required in the Contract Documents. This evidence may include a list of client references with names of current contacts and telephone numbers for whom you have worked within the last three (3) years. 3
