<br />E. METHOD OF MAKING AWARD u? <br />The total cost, quality, type of equipment, capabilities and reliability, available training <br />support, quality of available technical service support and the degree and quality of <br />dates and administrative support available, will be considered in determining which <br />proposal is most advantageous to the City and therefore the most responsive and <br />responsible bid. The City reserves the right to reject any and all bids and also the right <br />to waive any informalities in the bid. <br />F. DATE OF AWARD <br />The City will award or reject all bids at its next regular meeting following the opening <br />of the bid, or after notification to all bidders, postpone action until a later meeting. In <br />any event, bidder will guarantee bid price for sixty (60) days from the date of bid <br />opening. <br />The successful bidder will be notified, by letter mailed to the address shown on the bid, <br />that his bid has been accepted and that he has been awarded the contract. <br />G. CANCELLATION OF AWARD <br />The Service Director reserves the right to rescind the award of any Contract at any <br />time before the execution of said contract by all parties without any liability to the City. <br />H. EXECUTION OF CONTRACT <br />The contract shall be signed by the successful bidder and returned, together with the <br />required contract documents, within ten (10) days after the bidder has received notice <br />that the contract has been awarded. No proposal shall be considered binding upon the <br />City of North Olmsted until the execution of the contract. <br />FAILURE TO EXECUTE CONTRACT <br />Failure to execute the contract and file an acceptable bond shall be just cause for the <br />cancellation of the award and the forfeiture of the proposal guaranty which shall <br />become the property of the City, not made as a penalty, but in liquidation of damages <br />sustained. Award may be made to the next most responsive and responsible bidder or <br />the project may be advertised as the Service Director may decide. <br />J. COMPETENCY OF BIDDER <br />The opening and reading of the Proposal shall not be construed as an acceptance of the <br />bidder as a qualified, responsible bidder. The City reserves the right to determine the <br />competence and responsibility of a bidder from its knowledge of the bidder's <br />qualifications or from other sources. <br />In the event that the City shall require additional supporting data regarding the <br />qualifications of the Bidder in order to determine whether he is a qualified, responsible <br />Bidder, the Bidder may be required to furnish any or ail of the following information: <br />A. Evidence that the Bidder is capable of commencing performance as required in the <br />Contract Documents. This evidence may include a list of client references with names <br />of current contacts and telephone numbers for whom you have worked within the last <br />three (3) years. <br />3
