Ordinanee No. 781 <br />By Mr. Baum,gardner <br />AN ORDINANCE <br />ESTABLISHING THE COIJDITIONS OF EMPUJYMEIVT FOR h-MPIAYEES OF THE NORTH <br />OLMSTED NNNICIPAL BUS LINE, INCLUDING OPERATING AND NON-0PERATING <br />EW?AYEES. <br />Tr,iHEhEAS this Council desired to establish rules governing <br />the conditions of employment of the employees of t he North 0]lnsted Munici- <br />pal Bus Line; and the purpose of these conditions is to assure adequate and <br />dependable transit service to the public; to provide the employees wi.th <br />working conditions as good as may be reasonably possible; to protect the <br />interest of the employer and the Public; to provide a procedure for ad- <br />justing grievances or disputes arisi.ng from or pertaining to the employment <br />on the North Olmsted Municipal Bus line; to prescribe wnrking conditions <br />for employees; and to set forth narious other provisions relative to the <br />rights, privileges, duties and obligations of the employer and the employees; <br />now, therefore, <br />BE IT ORDAINED by the Council of the Village of North Olmsted, <br />State of Ohio: <br />Section l. For the purpose of discussing and conferring with <br />respect to any matter which concerns the employer-employee relationship, <br />but subject to such other eonditions, rules and provi.sions of law as may be <br />properly applicable thereto, the Transportation Comnittee of Council.will <br />meet witil the duly elected Committee of Employees of the North 0]msted <br />Municipal Bus Li.ne. <br />Section 2. Any employee to whom these conditions are applicable <br />who feels aggrieved because he has been diseharged or suspended by the em- <br />ployer or because of what he believes is a misapplication or misconstruction <br />of the terms or i.ntent of the conditions of employment herein provided for, <br />may proceed in the following manner: <br />a. Grievances shall be presented for adjustment immediately <br />but in no event more than ten days after the happening complained of. <br />b. An employee ma,;, present a gri.evance personally or through <br />the Committee of the hnployees Group to the Mayor, who shall refer the same <br />to the Transportation Coannittee of Council for a heari.ng. This ma,y be done <br />orally or in writing. The Mayor will inform the Commi.ttee or employee when <br />the Transportation Committee will hear the complaint or grievance and everar <br />effort will be made to settle grievar.ces as soon as possible. After the <br />Transportation Comm,ittee has heard the grievances, if said Comm.ittee is <br />unable to settle the matter, the same shall be referred to Council for its <br />action at the next regular meeting. <br />The N a.yc?r shall have the right to i.ntervene in any dispute between <br />the Committee of the Enployees Group and the Council if he deems it desirable <br />or necessary in the interest of the Village. <br />Section 3. SENIORITY. The men longegt in continuous service <br />shall have the first choice of runs and so on down the list until all runs <br />have been filled. The right of selection of runs will be granted to drivers <br />every three months and the driver shall have the right to make the selection <br />of his run i.n accordance with his seniority standing as provi.ded above, with <br />exception of emergency schedules. Any extra trips shall be given out according <br />to the seniority of the available drivers. All regular schedules will be <br />posted at least five days before going into effect, whenever possible, in <br />order to give each driver the opportunity to determine the run which he desires. <br />Vacancies shall be filled on the first of each mpnth. <br />When a driver has been granted a leave of absence for thirty <br />days or more, there shall irrmediate]Yy be granted a move-up on that particu- <br />lar run, or in caxe of siclrness where it is apparent that the employee will be <br />off for a period of thirty days or more, there shall be granted a mpve-up on
