ORDIAiANCE N0. 608 By Mr, Decker AbT ORDINANCE TO APPROVE AND IIvTER IAiTO AN AGREFMENT FOH THT dOINT EXTRCISE OF FOWIyRS CONFEtRED ON MUNICIPALITIES BY THE CONSTITUZ'ION AND GEIO?AL LAWS OF THE STATE OF OHIO, TO PROTECT THE LIVFS AND PftOPERTY OF TfE MUNCIPAISTIES AND THEIR INHABITAN?S DURING THE PRESENT ffiMERGENCY. Ohio : BE IT ORDAINID by the Council of the Uillage of ATorth Olmsted, Secti, l. This legislative bocy hereby approves arid this munici- pality hereby enters into, an agreement with each other mmicipality being or beconing a party to said agreemnt bp similar action on the part of its legislative bocly, which agreement shall be in the fo11oW3.ng texms: AGBEEMERTT WHFREAS Section 3615-1 af the General Code of Ohio provides that trro or more municipalitiea may enter irrto an agreement for the 3oint ezcer- cise of any power conferred on municipalities by the Constitution and lawa of the State of Ohio, and Section 3298-60 of the General Code of Ohio fur- ther providea that municipalities may enter into contracts for the eacchange of fire services; and WBERSAS it is dee,med desirable and necessary to invoke the authority so conferred by the statutes of Ohio in order to make pronpt and adequate provision during the preseat war emergency for the evicercise af the police power of the parties hereto cutside of their respective territorial jurisdictions, including all safety forces arid aervice forces as hereinaftsr referred to, both regula;, avxiliary and volnnteer, and also for the Pixiag of central responsibility, authox•ity and command, and the legalizing of aunici- pal eocpenditures for eactra-territorial services during such emergency; NOW, THEREFORE, in consideration oP the mutual a dvantages and the assumption of obligations, one to another., each of the parties hereto agrees tc> interchange fire., police, ambu].ance and other safety equipment and personnel., and eqvipment and personnel for the protection and repair of streets and utili- ties upon the follcwiag terms and conditiona; (g) Iharing pending or existing attack or unli.ffii.ted emergency as re- Yerred to in paragraph (c) hereof, and for the purpc>ses of nutual protection and safety, the Director of Public Safety of the Cit,y of Cleveland is hereby designated as Controller, the Chief of the Division of Poliee of thm City of Cleveland as First Assistant Controller, the Chief of the Division of Fire of the City of Cleveland as Second Assistant Controller, and the Directors of Piblic Safety of the remaining cities within Guy.ahoga County, who are then parties to this agreeaent as Assistant Cc>ntrollers,, ranking in accordance with the size of their respective regular safety forces. IIpon the establislment of a Ciei.lian Denense Warning Center in Cuyahoga County, the Controller and the Assistant Coatrollers shall have autlority and responsibility for the operation of the Civiliari Defense Warning Center in accordance xith the above designated ranking official and upon the conditions hereinafter set forth. (b) Civilian DeYense Report Centers shall be established and maintained in such mmeipalities and to eerve such areag as the Controller shall Yram tim to time designate. The municipality in t,rhich any such Report Center is ea- tabliahed sha11 provide space therefor in its municipal building or in some other cxDnvenient place and shall'_provide necessary furniture, equipanent and telephone facilities. The expense of establishing and maintaining any such report center shall be borne by the municipa.lity in which it is located,, axcept that if the center serves mpre than one municipality all munieipalitiea served by it shall contribute to such expense in proportion to their population at the lateat Federal census, and shall pay such contribution to the municipality providing facilities on bills from such mtanieipality. Each report center shall be operated by the municipality in Kh3.ch it is lvcated, under the general super- vision of the Controller or Assistant Controller.
