-ar <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 94-~g4 <br />BY.• MAYOR EDWARD BOYLE <br />AN ORDINANCE AUTHORIZING THE ANNEXATION OF <br />CERTAIN UNINCORPORATED TERRITORY CURRENTLY <br />LOCATED IN OLMSTED TOWNSHIP TO THE CITY OF <br />NORTH OLMSTED, DIRECTING THE DIRECTOR OF LAW <br />TO PURSUE MEASURES NECESSARY TO EFFECTUATE <br />SUCH ANNEXATION, AND DECLARING AN EMERGENCY. <br />WHEREAS, the unincorporated azea of Olmsted Township is subject to multiple <br />annexation proceedings that may result in haphazard and inconsistent growth, development and <br />planning for such area; and <br />VPHF.REAS, the City of North Olmsted in concert with the City of Berea is desirous of <br />permitting the annexation of a portion of Olmsted Township to the City of North Olmsted the <br />remaining portion being annexed to the City of Berea; and <br />WHEREAS, it is the desire and intent of this Administration and this Council to accept <br />the annexation of a portion of Olmsted Township upon the agreement by the electors of Olmsted <br />Township, and upon approval of the Cuyahoga County Commissioners, as called for under Ohio <br />law. <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF NORTH OLMSTED, COUNTY <br />OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1. That this Council hereby authorizes the annexation to the City of North <br />Olmsted of the temtory currently located in Olmsted Township, Ohio, and described on Exhibit <br />"A" attached hereto and incorporated herein by reference, the same being a legal description of <br />the territory proposed for annexation, including an accurate map thereof (Exhibit "B"), and such <br />annexation is hereby expressly authorized. <br />SECTION 2. That the City Director of Law is hereby authorized and directed to pursue <br />all measures necessary and proper to effectuate such annexation. <br />SECTION 3. That it is found and determined that all formal actions of this Council <br />concerning and relating to the adoption of this Ordinance were adopted in an open meeting of <br />this Council, and that all deliberations of this Council and of any of its committees that resulted <br />in such formal actions were in meetings open to the public, in compliance with all legal <br />requirements, including Section 121.22 of the Ohio Revised Code. <br />
