-ar CITY OF NORTH OLMSTED ORDINANCE NO. 94-~g4 BY.• MAYOR EDWARD BOYLE AN ORDINANCE AUTHORIZING THE ANNEXATION OF CERTAIN UNINCORPORATED TERRITORY CURRENTLY LOCATED IN OLMSTED TOWNSHIP TO THE CITY OF NORTH OLMSTED, DIRECTING THE DIRECTOR OF LAW TO PURSUE MEASURES NECESSARY TO EFFECTUATE SUCH ANNEXATION, AND DECLARING AN EMERGENCY. WHEREAS, the unincorporated azea of Olmsted Township is subject to multiple annexation proceedings that may result in haphazard and inconsistent growth, development and planning for such area; and VPHF.REAS, the City of North Olmsted in concert with the City of Berea is desirous of permitting the annexation of a portion of Olmsted Township to the City of North Olmsted the remaining portion being annexed to the City of Berea; and WHEREAS, it is the desire and intent of this Administration and this Council to accept the annexation of a portion of Olmsted Township upon the agreement by the electors of Olmsted Township, and upon approval of the Cuyahoga County Commissioners, as called for under Ohio law. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1. That this Council hereby authorizes the annexation to the City of North Olmsted of the temtory currently located in Olmsted Township, Ohio, and described on Exhibit "A" attached hereto and incorporated herein by reference, the same being a legal description of the territory proposed for annexation, including an accurate map thereof (Exhibit "B"), and such annexation is hereby expressly authorized. SECTION 2. That the City Director of Law is hereby authorized and directed to pursue all measures necessary and proper to effectuate such annexation. SECTION 3. That it is found and determined that all formal actions of this Council concerning and relating to the adoption of this Ordinance were adopted in an open meeting of this Council, and that all deliberations of this Council and of any of its committees that resulted in such formal actions were in meetings open to the public, in compliance with all legal requirements, including Section 121.22 of the Ohio Revised Code.
