' 07=Dec-1994 D R A F T T H R E E <br />adjusting, and reporting of all public liability and property damage claims, <br />which may arise as a result of the Agreement. <br />22.6 The City shall immediately notify the Authority of any accidents by <br />notifying the Authority's Traffic Control. Accident reports shall be submitted <br />within one (1) business day to the Authority's Chief Claims Adjuster. <br />22.7 The Authority shall become subrogated to the City for all claims arising <br />out of damage to property owned or utilized by the City to provide contracted <br />services, including but not limited to claims for damages to coaches and other <br />vehicles and capital-improvements funded by the Authority and in which the <br />Authority has an ownership interest pursuant to the terms and conditions of <br />this Agreement. <br />22.8 In the event the Authorit determines that it would be in its best <br />interest to purchase liability insurance for any liability for which it may <br />become liable arising out of the contracted services, the Cit agrees to <br />cooperate with the Authority to obtain such insurance and shall be named as an <br />additional insured with respect to the contracted service provided according to <br />the terms of this Agreement. The City shall, if required by the Authority, <br />procure such insurance as this Authority deems appropriate The Authority <br />shall be named as an additional insured and shall be responsible for the <br />payment of such premium costs. <br />22.9 The Authority agrees, to the extent it is permitted to do so, to name the <br />City of North Olmsted as an additional insured on its Property Damage Insurance <br />Policy for buses loaned to the City under the terms of this Agreement. <br />22.10 The Authority agrees to waive any claims against the City for amount not <br />covered under the term of the Authority's Property Damage Insurance Policy <br />-28- <br />
