07=Dec-1994 D R A F T T H R E E <br />Authority all Authority property, including but not limited to loaned vehicles <br />in the City's possession and all capital improvements paid for by the Authorit <br />which are not of a fixed and permanent nature and to pay to the Authority such <br />sums as may be required under the term of this agreement <br />23.8 If this contract is terminated the Authorit shall be liable onl for <br />payment under the payment provisions of this contract for services rendered <br />before the effective date of termination. <br />24. NOTICE OF DEFICIENCY <br />The Authority shall issue a written notice of deficiencies to the City, <br />specifying areas of unsatisfactory performance and specifying what improvements <br />are necessary to correct the deficiency and establishing a reasonable timetable <br />for improvements. <br />25. AIITHORITY'S REMEDIES ON BREACH <br />It is understood and agreed that, in the event of failure by City to <br />perform services required by this Agreement, in addition to all other remedies, <br />penalties and damages provided by law and this Agreement, the Authority may <br />provide such services and deduct the cost of doing so from the. amounts due or <br />to become due to the Gity. The costs to be deducted shall be the actual costs <br />to the Authority to provide such services and shall not exceed the amounts <br />provided for in the Cost Reimbursement schedule. <br />26. LOANED VEHICLES <br />26.1 The Authority shall provide at no additional cost to the City additional <br />buses as may be required to perform the public transit services contracted for <br />herein. <br />26.2 The buses provided shall be made available to the City on equitable basis <br />-31- <br /> <br />
