Dancik to Thomas Coury, <br />subject to a restrictive covenant as described in SECTION X below. Purchaser expressly <br />acknowledges and agrees herein that he will accept title to the Dancik property subject to said <br />restrictive covenant. <br />Purchaser shall receive possession of the Dancik property following closing on or <br />;about December 15, 1994, and of the O'Grady property following closing on or about <br />i <br />February 1, 1995. <br />SECTION VII <br />RISK OF LOSS OR DAMAGE <br />The risk of loss or damage by fire or other casualty or cause to either of the premises <br />involved in this transaction before delivery of the deed or written assignment is hereby <br />assumed by Seller. <br />In the event of such loss or damage, this Agreement shall not be affected but Seller <br />shall assign to Purchaser all of its rights under any insurance policies applicable with respect <br />'. i <br />;~ <br />~,, to any such loss or damage, or, if Purchaser shall so request, Seller shall permit Purchaser to <br />i recover in Seller's name, but at Purchaser's own expense, the amount of such loss on such <br />~; <br />I <br />policies, or, if Seller sues in its own name to recover the amount of such loss or damage, it <br />~~ <br />;i <br />shall assign the amount so recovered to Purchaser less expenses of recovery. <br />~~ <br />7 <br />
