,.~ <br />.~ <br />SECTION VIII <br />OTI~R CONTRACT IlWOLVED <br />Seller warrants that it entered into the Purchase Agreement for the. purchase of the <br />Dancik property therein with the parties who aze the present owners thereof respectively, and <br />;that Seller was duly authorized by law to enter into said Purchase Agreement. Seller warrants <br />that, to date, the said Purchase Agreement has neither been modified in writing or verbally by <br />,; <br />the parties thereto, and that Seller continues to have the right to purchase the premises <br />~~ <br />described therein on a date subsequent to the date hereof. Seller shall timely furnish <br />Purchaser, upon request, with information and assurances satisfactory to him or his attorneys <br />'' that there will be no default on the part of the City of North Olmsted under the said Purchase <br />~' Agreement. Purchaser aclmowledges and agrees herein, however, that the City of North <br />Olmsted may enter into an agreement amending said Purchase Agreement to require that the <br />1~ % Sellers of the Dancik property convey title to said property to Purchaser herein subject to a <br />~' restrictive covenant as described in SECTION X below. <br />SECTION IX <br />ZONING <br />Seller agrees and covenants that it shall rezone the O'Grady and Dancik properties to <br />Senior Residence District, as that use is defined and provided for in Chapter 1138 of the <br />Zoning Code of the City of North Olmsted, so as to permit their use by Purchaser <br />s <br />
