r <br />~~. <br /> <br />SECTION III <br />ASSUMPTION OF SELLER'S OBLIGATION <br />In addition to the purchase price set forth above, Purchaser agrees and covenants that <br />he shall assume all of Seller's obligations in the above-referenced Purchase Agreement, and '. <br />any amendments to said Purchase Agreement, relating to the purchase of the Dancik property. <br />A copy of said Purchase Agreement is attached to this Contract at Schedule "C. " The <br />obligations imposed upon the City of North Olmsted in the said Purchase Agreement and any <br />amendments thereto, and assumed herein by Purchaser, are expressly made covenants, terms <br />i <br />'' ~ and conditions of this Contract. <br />SECTION IV <br />DEED AND ASSIGNMENT <br />The conveyance of the O'Grady property shall be by general warranty deed with full <br />covenants executed at Seller's sole expense, in proper form for recording so as to convey to <br />the Purchaser a good and marketable record title to the land and improvements clear and free <br />'; of all liens, encumbrances, leases, restrictions, and conditions, except as provided herein. <br />The closing of title shall be conditional on delivery of good and marketable title and the <br />,~ <br />'~ <br />issuance of a title insurance policy to such effect reasonably satisfactory to purchaser by a <br />reputable title insurance company. It is understood that title to the real property is not <br />'' derived by or through tax title, or by adverse possession. <br />4 <br />
