<br />V11p. <br /> <br />The Board of Rducatioa of the North Olmsted City School <br />District met is regular sessioa oa Juae 13, 1994 at 8:00 o'clock, <br />p.m., in the Board Offices, North Olmsted, Ohio, with the following <br />members present: <br />Cla c~ Ha~P~~ PreGic7Pnt Aoanne Di Carlo, Vice President <br />Donald Frazier Jean Bartoo <br />------- E <br />The Treasurer advised the Board that the notice requirements of Section 121.22 of <br />the Revised Code and the implementing rules adopted by the Board pursuant thereto were <br />complied with for the meeting. <br />Joanne D i car 1 o moved the adoption of the following resolution: <br />RESOLUTION N0.139 <br />A RESOLUTION AUTHORIZING THE TRANSFER OF CERTAIN REAL <br />PROPERTY AND INTERESTS IN REAL PROPERTY TO THE CITY OF <br />NORTH OLMSTED AND AN AGREEMIIVT RELATING THERETO. <br />WHEREAS, the City of North Olmsted has recently acquired property adjacent to <br />the site of the Birch Elementary School on which it plans to construct a new firehouse; and <br />WHEREAS, in order to extend sanitary and storm sewer service to that property the <br />City wishes to acquire an easement through the Birch School property for both storm and <br />sanitary sewer lines; and <br />WHEREAS, in order to properly provide for parking and fire equipment movement <br />on that site the City has requested this Board of Education transfer a small portion of the site <br />of the Birch Elementary School to the City; and <br />WHEREAS, in consideration for the transfer of such properly and the granting of <br />such easements the City has agreed to make certain improvements to the street entrance aprons <br />of the driveways on the Birch Elementary School property and to the streets and intersections <br />related to Birch Elementary School and, after installing, repairing or maintaining the aforesaid <br />sewers, to restore the Birch Elementary School property; and <br />WHEREAS, this Board determines that it is necessary to transfer the aforesaid <br />property and interests in property in order to assist the City in the construction of the firehouse <br />which will benefit not only the citizens of North Olmsted but also this Board of Education; <br />NOW, THEREFORE, BE IT RESOLVED by the Board of Education of the North <br />Olmsted City School District, County of Cuyahoga, State of Ohio, that: <br />Section 1. This Board hereby fords, determines and declares that a portion of the <br />Birch Elementary School property (Permanent Parcel No. 237-013) is no longer needed for <br />school purposes and, pursuant to Revised Code Section 3313.41(C), it is necessary to transfer <br />such portion of that property to the City of North Olmsted to assist in the construction of a <br />firehouse on Permanent Parcel No. 237-4-2 between Lorain Road and the Birch Elementary <br />School property, all as set forth in the Agreement now on file in the office of the Treasurer of <br />this Board. <br />
