This Board hereby finds, determines and declares that it is necessary to grant an easement across the Birch Elementary School property (Permanent Parcel No. 237-4- 013) to the City of North Olmsted for the installation of sanitary and storm sewers to serve the aforesaid new firehouse, all as set forth in the Agreement now on file in the office of the Treasurer of this Board. Section 3. In order to accomplish the transfer of property and the granting of the easement set forth in Sections 1 and 2 of this Resolution, the President of this Board of Education and the Treasurer are authorized to execute an Agreement between the School District and the City substantially in the form now on file in the office of the Treasurer of this Board. That Agreement is approved, together with any changes or amendments thereto which are not inconsistent with this Resolution and are not substantially adverse to the School District and that are approved by the President and Treasurer on behalf of this School District, all of which shall be conclusively evidenced by the signing of the Agreement or amendments to the Agreement by the President of the Board and the Treasurer. Section 4. This Board fords and determines that all formal actions of this Board concerning and relating to the adoption of this Resolution were taken in an open meeting of this Board and that all deliberations of this Board and of any of its committees that resulted in those formal actions were in meetings open to the public in compliance with the law. Section 5. This Resolution shall be in full force and effect from and immediately upon its adoption. Dona 1 d Frazier seconded the motion.
