<br />909.04 DIDUCTION AND REFUND <br />When such work is completed to the satisfaction of the City Engineer, <br />the cost of inspection and supervision shall be forwarded to the Finance <br />Director, who shall deduct from the deposit made by the applicant the cost <br />incurred by the City and shall issue a check to the applicant for the return <br />for the excess over and above the amount necessary to reimburse the City for <br />the cost of inspection and supervision. Where the repair work is done by or <br />under the direction of the City, the cost of such work shall be deducted <br />from the deposit required under Section 909.01 together with the cost of <br />engineering and supervision. Any excess remaining, after payment of charges <br />for such work, shall be returned to the applicant as provided above. <br />909.05 INSUFFICIENT DEPOSIT <br />If the deposit is insufficient to reimburse the City, the Engineering <br />Division shall collect from the applicant a sufficient amount to reimburse <br />the City for the expense incurred. If the applicant fails to deposit <br />sufficient funds to reimburse the City for the cost of inspection and <br />general supervision or anticipated repairs within three days of notice to do <br />so, then the City Engineer may issue an order to stop work for all or part <br />of the work associated with the street opening. Failure to heed such stop <br />work order shall be cause to revoke the permit to cut the curbing. <br />909.99 PENALTY <br />Whoever violates any provision of this chapter is guilty of a <br />misdemeanor of the fourth degree. Any such violation shall constitute a <br />separate offense on each successive day continued." <br />
