,.~..>.. _....~ d4 v...rr _..,. <br /> <br />Ordinance No . 94 - 58 <br />903.99 PENALTY. <br />Whoever violates any provision of this chapter is guilty of a minor <br />misdemeanor. Any such violation shall constitute a separate offense on each <br />successive day continued." <br />BE AND THE SAME IS HEREBY AMENDED, AND AS AMENDID, SHALL READ AS FOLLOWS: <br />Page 2 <br />"903.01 PERMIT REQUIRED; FEES. <br />No person, except in cases of undedicated subdivisions or in streets where <br />special assessments are to be made, shall install, construct or replace sidewalks <br />in or on any public street or highway or other public property without first <br />obtaining a permit to do so from the Service Director. <br />The Service Director shall demand and receive a fee of Thirty Dollars <br />($30.00) for each five hundred (500) square feet or fraction thereof of sidewalk <br />before the issuance of any such permit. This amount is necessary to defray the <br />costs of administration and inspection to insure conformance of the work to City <br />specifications. If construction is commenced prior to obtaining the permit, the <br />fee shall be Sixty Dollars ($60.00) for each five hundred (500) square feet, or <br />fraction thereof of sidewalk. <br />No portion of the fee shall be refundable. <br />903.02 CONSTRUCTION STANDARDS. <br />The following standards regarding the construction or reconstruction of <br />sidewalks within the City are hereby established: <br />(a) On local residential streets, sidewalks shall be located in the public <br />right-of-way so that the inner line is approximately one foot from the <br />property line. On corner lots, each sidewalk shall be extended to the <br />curb. In one-family and multi-family residential developments, <br />industrial developments and business developments, walks shall be not <br />less than five (5) feet wide. <br />(b) Sidewalks shall be constructed of concrete four (4) inches thick, <br />except that where they are crossed by driveways, they shall not be <br />less than six (6) inches thick. Moreover, all sidewalks shall be in <br />accordance with other City standards for construction. <br />(c) Sidewalks shall be constructed for all new buildings or residences <br />along the entire right-of-way line of the parcel. The Service <br />Director may waive this requirement if less than one-fourth of the <br />existing buildings or residences on the street have a sidewalk in <br />front of their parcel of land. <br />
