Ordinance No. 94 57 <br />Page 3 <br />(b) If the City Engineer should determine that the items specified in <br />subsection (a) hereof are insufficient and a flagman will be required, <br />then the contractor shall present to the City Engineer evidence that a <br />flagman will be on duty to direct traffic at times when the City <br />Engineer deems necessary or appropriate. <br />(c) In the event a permit is not issued, as in the case of a government <br />project, i.e., Federal, State, County or City, the same requirements <br />shall apply as are outlined in subsections (a) and (b) hereof. <br />901.09 PELQALTY. <br />Any person, firm or corporation who shall make any opening or remove the <br />pavement in any street, boulevard, avenue or public ground of the City without <br />having first obtained a permit from the Engineering Division and having deposited <br />with the City the estimated cost of repairing such work or filing the bond <br />hereinbefore set forth, is guilty of a misdemeanor of the fourth degree." <br />BE A1~ID THE SAME IS HEREBY AMENDID, AND AS AMENDID SHALL READ AS FOLLOWS: <br />"901.01 PERMIT REQUIRID; FEE AND APPLICATION. <br />(a) No person shall make any opening in any street, boulevard, avenue or <br />public place in the City until such person has filed with the City <br />Engineering Division a written or printed application setting forth and <br />indicating there the location, kind and extent of the pavement desired <br />to be removed, and the number, purpose and size of openings or <br />excavations which are desired or necessary. The applicant shall pay a <br />permit fee to the City in the amount of Fifty Dollars ($50..00) to the <br />General Fund before the permit is issued and shall deposit with the <br />City an additional amount sufficient to cover the cost of repairing or <br />relaying and also the cost of materials needed for repairing or <br />relaying the treelawn, roadway or paving removed or damaged as a result <br />of work done on or under the streets and public rights of way of the <br />City, plus Fifteen Percent (15%) for the cost of inspection and general <br />supervision, as shall be estimated by the Engineering Division of the <br />City. <br />(b) In the event that the street opening is commenced prior to the payment <br />of the permit fee and deposit referred to in subsection (a), then the <br />applicant shall pay a permit fee to the City in the amount of One <br />Hundred Fifty Dollars ($150.00) to the General Fund in addition to the <br />deposit otherwise required in subsection (a). The City Engineer may <br />issue a stop work order until such time as the permit fee and deposit <br />money have been received by the City. <br />(c) The minimum deposit for pavement borings or openings referred to in <br />subsection (a) shall be as follows: <br />1. Brookpark Road, Columbia Road (S.R. 252 south of Butternut Ridge <br />Road), Great Northern Boulevard, and Lorain Road $3,000.00 <br />2. Al Moen Drive, Brookpark Road Extension, Country Club Boulevard, <br />Dover Center Road, Industrial Parkway, and Sparky Lane. $2,500.00 <br />3. Barton Road, Bradley Road, Butternut Ridge Road, Canterbury Road, <br />Cedar Point Road, Clague Road, Columbia Road (except S.R. 252 south <br />of Butternut Ridge Road) Fitch Road, Lessner Road, Kennedy Ridge <br />Road (between Victoria Lane and Butternut Ridge Road), McKenzie <br />Road, Mastick Road, Mill Road, Porter Road, Stearns Road, Victoria <br />Lane and Walter Road. $2,000.00 <br />
