,. <br />_._ _ _. <br />,, <br />,,~ <br />THE CITY OF NORTH OLMSTED <br />ORDINANCE NO. 94- g <br />BY: Councilman Limpert <br />AN ORDINANCE APPROVING THE FINAL DRAFT SOLID <br />WASTE MANAGEMENT PLAN OF THE CUYAHOGA <br />COUNTY SOLID WASTE MANAGEMENT DISTRICT, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Ohio Solid Waste Disposal Act, effective June 24, 1988, mandated that all <br />counties establish a Solid Waste District and a Solid Waste Management Policy Committee to prepare, <br />adopt and submit to the Ohio Environmental Protection Agency a Solid Waste Management Plan <br />(Sections 3734.52-.56, Ohio Revised Code; and <br />WHEREAS, through its Resolution No. 814313, adopted August 29, 1988, the Cuyahoga <br />County Board of Commissioners formed asingle-county Solid Waste Management District, in <br />accordance with Section 3734.52 of the Ohio Revised Code; <br />WHEREAS, the Director of the Ohio Environmental Protection Agency, on March 30, 1989, <br />designated the Cuyahoga County Planning Commission to serve as the Solid Waste Management <br />Policy Committee for the Cuyahoga County Solid Waste District (the "Policy Committee") pursuant to <br />Section 3734.54(D) of the Ohio Revised Code, which Policy Committee is required to prepare a "solid <br />waste management plan" for the District as required by Section 3734.54 (Plan); and <br />WHEREAS, the Policy Committee completed a draft Plan for the District and submitted that <br />Plan to the Director of the Ohio Environmental Protection Agency for preliminary review and <br />comment in accordance with Sections 3734.54 and 3734.55 of the Revised Code; and <br />WHEREAS, the Policy Committee received the Director's written, nonbinding advisory <br />opinion regarding the draft Plan and established a public comment period and held three public <br />hearings concerning the draft Plan; and <br />WHEREAS, the Policy Committee, after consideration of comments and recommendations <br />received concerning the draft Plan, made certain modifications to the draft Plan and has adopted and <br />submitted to this legislative authority a copy of the draft Plan for the District as so modified (the <br />"Final Draft Plan"); and <br />WHEREAS, this legislative authority is required by Division (B) of Section 3734.55 of the <br />Revised Code to approve or disapprove the Final Draft Plan within 90 days after receiving a copy of <br />the Final Draft Plan and has been requested to approve the Final Draft Plan; <br />
