FOURTH AGREEMENT <br />between <br />CITY OF NORTH OLMSTED, OHIO <br />and <br />QUALITY QUICK SNACKS <br />for <br />VENDING MACHINES AND VIDEO GAMES FOR <br />THE NORTH OLMSTED RECREATION CENTER <br />THIS AGREEMENT made at North Olmsted, Ohio, on the ~ day of January, <br />2010, by and between the City of NORTH OLMSTED, 5200 Dover Center Road, North <br />Olmsted, Ohio 44070 [hereinafter referred to as "CITY"], and BOB'S ICE CREAM, <br />INC., d.b.a. QUALITY QUICK SNACKS [hereinafter referred to as "CONTRACTOR"]; <br />WHEREAS, pursuant to Section 111.01 of the North Olmsted Codified <br />Ordinances, a request for proposals was prepared and advertised in accordance with law <br />for vending and video game machine products and services for the North Olmsted <br />Recreation Center [hereinafter referred to as the "SERVICES"] under the direction (then) <br />of the Safety Department of the City of North Olmsted; and <br />WHEREAS, CONTRACTOR submitted a proposal that was deemed to be the <br />best submitted and was appro ~ ed by the CITY's Board of Control, and the Council <br />subsequently, pursuant to Ordinance No. 2004-07, authorized the Mayor to enter into a <br />two-year contract with CONTRACTOR during the period January 24, 2004 through <br />January 23, 2006 (first term); and <br />WHEREAS, the City being satisfied with the quality of the SERVICES provided <br />by CONTRACTOR in the first term, the CITY Council, pursuant to Ordinance No. 2005- <br />150, authorized a new two-year contract, subsequently executed by the parties, for the <br />period January 24, 2006 through January 23, 2008 (second term); and <br />WHEREAS, the City being satisfied with the quality of the SERVICES provided <br />by CONTRACTOR in the second term, the CITY Council, pursuant to Ordinance No. <br />2008-08, authorized a new two-year contract, subsequently executed by the parties, for <br />the period January 24, 2008 through January 23, 2010 (third term); and <br />
