FOURTH AGREEMENT between CITY OF NORTH OLMSTED, OHIO and QUALITY QUICK SNACKS for VENDING MACHINES AND VIDEO GAMES FOR THE NORTH OLMSTED RECREATION CENTER THIS AGREEMENT made at North Olmsted, Ohio, on the ~ day of January, 2010, by and between the City of NORTH OLMSTED, 5200 Dover Center Road, North Olmsted, Ohio 44070 [hereinafter referred to as "CITY"], and BOB'S ICE CREAM, INC., d.b.a. QUALITY QUICK SNACKS [hereinafter referred to as "CONTRACTOR"]; WHEREAS, pursuant to Section 111.01 of the North Olmsted Codified Ordinances, a request for proposals was prepared and advertised in accordance with law for vending and video game machine products and services for the North Olmsted Recreation Center [hereinafter referred to as the "SERVICES"] under the direction (then) of the Safety Department of the City of North Olmsted; and WHEREAS, CONTRACTOR submitted a proposal that was deemed to be the best submitted and was appro ~ ed by the CITY's Board of Control, and the Council subsequently, pursuant to Ordinance No. 2004-07, authorized the Mayor to enter into a two-year contract with CONTRACTOR during the period January 24, 2004 through January 23, 2006 (first term); and WHEREAS, the City being satisfied with the quality of the SERVICES provided by CONTRACTOR in the first term, the CITY Council, pursuant to Ordinance No. 2005- 150, authorized a new two-year contract, subsequently executed by the parties, for the period January 24, 2006 through January 23, 2008 (second term); and WHEREAS, the City being satisfied with the quality of the SERVICES provided by CONTRACTOR in the second term, the CITY Council, pursuant to Ordinance No. 2008-08, authorized a new two-year contract, subsequently executed by the parties, for the period January 24, 2008 through January 23, 2010 (third term); and
