CITY OF NORTH OLMSTED <br />ORDINANCE N0.2010 - 92 <br />BY: Mayor Kennedy <br />AN ORDINANCE PROVIDING FOR THE SUBMISSION OFAN <br />AMENDMENT TO THE ELECTORS OF THE CITYOFNORTH <br />OLMSTED TO ARTICLE VI, SECTION 3 OF THE CHARTER <br />OF THE CITY OF NORTH OLMSTED TO IDENTIFY AND <br />REDEFINE MEMBERS OF THE UNCLASSIFIED SERVICE, <br />AND DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, the Charter of the City of North Olmsted currently sets forth that all employees <br />of the City of North Olmsted are members of the classified service of the City of North Olmsted, <br />unless expressly excluded therein; and <br />WHEREAS, members of the classified service are cloaked with all the rights and privileges <br />afforded employees under the laws, rules and regulations governing civil servants in the State of <br />Ohio and City of North Olmsted; and <br />WHEREAS, the current Charter framework for the classified service over the years has <br />evolved into an inconsistent and illogical system, such that it inexplicably excludes from the <br />classified service assistants to Division Heads but includes assistants to Directors and, additionally, <br />includes in its membership Waste Water Treatment Plant Workers know as Sludge Handler I's but <br />excludes Sludge Handler II's; and <br />WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a <br />proposal to amend Article VI, Section 3 of the Charter of the City of North Olmsted so as identify <br />and redefine membership in the unclassified service of the City of North Olmsted; and <br />WHEREAS, this proposal was reviewed and recommended by the Charter Review <br />Commis,,}},,o~~n~ in accordance with Article XIV, Section (b)(1) of the City Charter, and the Commission <br />on the ~~%day of ~~, 2010, filed a written report with the Clerk of Council in which the <br />Commission stated that, by a ~ to (' vote, a motion to recommend approval of the proposal <br />(passed)(failed); and <br />WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner <br />than 120 days, and no later than 60 days, prior to the date of the election at which the issue will be <br />voted upon by the electorate. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, OHIO, TWO-THIRDS OFALL MEMBERS <br />CONCURRING THAT: <br />SECTION 1.
