All positions wherein the holders of said positions are members of a collective <br />bargaining unit governed by a Collective Bargaining Agreement between the <br />City of North Olmsted and said Bargaining Representative which agreement <br />provides for the governing of the rights, duties and obligations of the <br />Bargaining Unit and the City of North Olmsted. However, any positions which <br />are filed by competitive examination or promotions which are accomplished <br />through competitive examinations, the procedures, rules and regulations of the <br />North Olmsted Civil Service Commission as now adopted or hereafter amended <br />shall govern such examination process only. Any conflict between the Rules <br />and Regulations of the Civil Service Commission regarding matters other than <br />examinations to determine merit and fitness shall be governed by the Collective <br />Bargaining Agreement. <br />B. The Classified Service shall comprise all positions not specifically included in this <br />Charter in the Unclassified Service. <br />SECTION 2. If the foregoing proposal receives the affirmative vote of a majority of the <br />electors voting thereon, then the said amendment to Article VI, Section 3 of the Charter shall be <br />effective upon certification of such affirmative vote following the election on November 2, 2010. <br />SECTION 3. It is the desire of the Council that the ballot for said question shall be in <br />substantially the following form: <br />PROPOSED CHARTER AMENDMENT <br />A majority affirmative vote is necessary for passage. <br />Shall Article VI, Section 3 of the Charter of the City of North <br />Olmsted be amended to redefine and restate those positions in the <br />Civil Service of the City, so as to exclude from the Civil Service <br />Directors and Assistants to Directors; managerial positions having <br />supervisory responsibilities (except the chiefs of police and fire); all <br />skilled and unskilled positions when it is impractical to utilize a <br />competitive examination; and positions represented by a bargaining <br />unit that is signatory to a Collective Bargaining Agreement, except <br />that such Bargaining Unit employees shall remain subject to the <br />3 <br />
