(d) Applications must conform to the regulations of this chapter in all <br />particularities. If the Mayor's designee, upon review of the application, <br />discovers any irregularity or defect therein, the application shall be denied <br />for failure to conform to these regulations. <br />(e) Applications shall be acted upon by the Mayor's designee, in writing, <br />within ten working days following the date of filing of the application. <br />Applications shall be routinely granted, and may not be denied by the <br />Mayor's designee, unless the application, or the proposed announcement, <br />fails to conform to at least one express provisions of this chapter. <br />Decisions denying an application shall be mailed to the applicant by <br />certified mail, return receipt requested. No application shall be denied <br />unless the reason for denial has first been reviewed by the Director of <br />Law. <br />177.04 CONTENT REGULATIONS FOR SIGNS AND BANNERS. <br />The City is establishing a nonpublic forum in the airspace above the City right-of- <br />way at the location described in Section 177.01(a)(1), and with regard to the two <br />changeable copy signs as described in Section 177.01(a)(2) and (3). Only the <br />announcement of community events by community organizations is permitted in such <br />nonpublic forums. Accordingly, any proposed message must be a single event <br />announcement. The City will publish only the date, time, and location of such an event <br />open to the public, along with the title of the event, so long as the title fits within the <br />number and size of characters available on a banner as defined below in Section 177.06. <br />Applications containing titles that are too lengthy will be denied. No title will be edited <br />by City personnel. Exclusionary criteria for evaluating community announcements may <br />include, but not be limited to, the following: <br />(a) No announcements communicating events sponsored by a business-for- <br />profit. <br />(b) No announcements communicating events for organizations whose <br />primary purpose is to disparage or promote any person or class of persons, <br />particularly with regard to race, gender, national origin, age, religion, <br />economic status, handicapped status, or sexual orientation. <br />177.05 CONTENT REGULATIONS FOR CITY HALL WEBSITE. <br />(a) The City is establishing a nonpublic forum with regard to the City's <br />website as described in Section 177.01(a)(4). Exclusionary criteria for <br />evaluating internet sites may include, but not be limited to, the following: <br />(1) No links to any organization whose primary purpose is business- <br />far-profit. <br />(2) No organizations promoting tourism outside the City of North <br />Olmsted. (Exceptions may be made for State-wide tourist <br />organizations whose internet sites include North Olmsted among <br />other content). <br />(3) No links to sites that offend community standards of decency. <br />Links will not be granted to internet sites containing textual or <br />graphical content that appeals primarily to prurient sexual interests <br />or is obscene, or pornographic.
