CITY OF NORTH OLMSTED, OHIO <br />RESOLUTION NO. 2010- 125 <br />BY: Mayor Kennedy <br />A RESOLUTION EXTENDING THE MORATORIUM ON THE ISSUANCE <br />OF BUILDING, ZONING OR OCCUPANCY PERMITS FOR PREMISES <br />EQIIIPPED WITH MECHANICAL OR ELECTRONIC GAMING DEVICES <br />AND INTERNET CYBERCAFES; AND FURTHER EXTENDING THE <br />PROHIBITION AGAINST ANY SIMILAR ZISE PERMIT, VARIANCE OR <br />DEVELOPMENT PLANAPPROVAL PENDING REGULATIONS FOR SAID <br />FACILITIES, AND DECLARING AN EMERGENCY. <br />WHEREAS, on April 6, 2010, this Council passed Resolution No. 2010-41 and thereby <br />declared a temporary moratorium until October 5, 2010 (approximately six (6) months) on the <br />issuance of licenses, permits for occupancy and/or use of premises for internet cybercafes or <br />similar electronic video gaming devices, described in reference to "sweepstakes" gaming, as well <br />as any other administrative provision to allow for such use of property or license therefore; and <br />WHEREAS, this Council is considering Ordinances Nos. 2010-111 and 2010-112 as <br />comprehensive licensing and zoning regulations to address of the use of property for said internet <br />cybercafes for sweepstakes gaming, as similar legislation has been introduced in surrounding <br />suburbs; and <br />WHEREAS, this Council is conducting public hearings on Ordinance No. 2010-112 and <br />has granted the Planning and Design Commission additional time in which to study and make <br />recommendations to this Council regarding such uses; and <br />WHEREAS, thereafter, upon affirmative action of this Council, if any, on Ordinance No. <br />2010-112, it will not become effective until thirty (30) days thereafter and it is necessary to <br />extend the moratorium until such time as the zoning regulations take effect; and <br />WHEREAS, should this Council adopt Ordinance No. 2010-111, enacting new Chapter <br />752 to impose licensing regulation upon so-called sweepstakes parlors, then the extension of this <br />maratorium would not need to be extended with respect to Game Room license application under <br />existing Chapter 751; and <br />WHEREAS, this Council considers a sixty (60) day extension of the said Moratorium as <br />an emergency measure for the immediate preservation of the public peace, property, health, <br />safety, or general welfare in that an extension of the current temporary moratorium for up to an <br />additional sixty (60) days from October 5, 2010, or until the effective date of Ordinance 2010- <br />112, whichever comes sooner, is necessary to enable this Council to continue its consideration of <br />reasonable regulation of the location of these facilities. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO:
