SECTION 1: For the reasons stated in the preamble to this Ordinance, this Council <br />extends the moratorium instituted by Resolution 2010-41, generally barring the issuance of <br />licenses, permits, or certificates of occupancy for internet cyberspace cafes and/or sweepstakes <br />gaming devices or parlors, as more technically described in said Resolution, which is <br />incorporated herein by reference, through either the effective date of Ordinance No. 2010-112 - <br />a zoning ardinance regulating such use of premises or December 6, 2010, whichever date occurs <br />first. The definitions and restrictions set forth in Ordinance No. 2010-41 are incorporated herein <br />by reference as if fully re-written, except however that the extension of the moratorium will only <br />apply to licenses issued under Chapter 752 (as created by Ordinance No. 2010-1 ll) and shall not <br />apply to or prohibit Game Room license applications pursuant to North Olmsted Codified <br />Chapter 751 after the effective date of Ordinance No. 2010-111, if adopted by Council. <br />SECTION 2: It is found and determined that all formal actions of this Council <br />concerning and relating to the adoption of this Ordinance were adopted in an open meeting of <br />this Council, and that all deliberations of this Council and of any of its committees that resulted <br />in such formal action, were in meetings open to the public, in compliance with all legal <br />requirements, including Section 121.22 of the Ohio Revised Code. <br />SECTION 3: This Ordinance is declared to be an emergency measure immediately <br />necessary for the preservation of the public peace, health, safety and general welfare of the <br />citizens and visitors of the City of North Olmsted, Ohio and for further reason that it is <br />immediately necessary in order for this Council to consider reasonable regulation of the use of <br />premises and additional regulations for those facilities identified by Ordinance 2010-41, to <br />adequately consider comments made the Planning and Design Commission, to continue to the <br />moratorium in effect through the effective date of such zoning regulation, if adopted and to <br />prevent unregulated proliferation of these facilities.
