CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2010 - 128 <br />By: Mayor Kennedy and Council Member Barker <br />AN ORDINANCE AMENDING SECTION 112610 OF THE NORTH <br />OLMSTED ZONING CODE ENTITLED "EXPIRATION OF <br />APPROYAL," TO AUTHORIZE THE DIRECTOR OF PLANNING <br />AND DEVELOPMENT TO ADMINISTRATIVELY EXTEND <br />ESTABLISHED TIME LIMITA TIONS, AS AMENDED. <br />WHEREAS, the zoning code as currently enacted provides that when an applicant <br />administratively obtains approval of a development plan through Council or when an approval is <br />granted pursuant to a"minor change" request under Section 1126.08 by the Director of Planning <br />and Development, the approval shall expire after the passage of one (1) year in the event that the <br />successful applicant fails to obtain from the Building Official a building permit within that time <br />frame; and <br />WHEREAS, it is the recommendation of the Mayor and the Director of Planning and <br />Development that such section be amended to permit the Director of Planning and Development to <br />administratively extend the approval rendered by Council or the Director of Planning and <br />Development in the case of a"minor change," for a period of up to one (1) year; and <br />WHEREAS, it is the desire of this Council to authorize and permit the Director of Planning <br />and Development to administratively extend approvals rendered by the Council or the Director, for <br />a period of up to one (1) year; and <br />WHEREAS, after careful consideration, the Planning and Design Commission of the City, <br />on the 4T day of 2010, by formal motion, recommended that this Ordinance <br />amending Section 1126.10 of the Zoning Code, entitled "Expiration of Approval," be (approved) <br />(disap proved); and <br />WHEREAS, following publication of newspaper notice in conformance with the <br />provisions of Section 14 of Article IV of the Charter and Section 1127.03 of the Zoning Code, a <br />public hearing was held on the 3 day of a?y i1 #ut b v- , 2010; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 1126.10 of the Zoning Code of the City of North which <br />reads as follows:
