1126.10 EXPIRATION OF APPROVAL <br />After any development plan or application for a building permit has been finally approved <br />by Council, or approved with respect to a"minor change" as provided for in Section <br />1126.08, the applicant shall take all necessary steps and meet all legal requirements in <br />order to timely obtain a building permit from the Building Official. In the event that the <br />applicant fails to obtain a permit within one year of final approval as set forth above, the <br />approval shall expire. With respect to any final approval granted before the effective date <br />of this provision of the Zoning Code, the applicant's approval shall expire on the one year <br />anniversary date of enactment of this provision. <br />BE AMENDED AND, AS AMENDED, SHALL READ IN ITS ENTIRETY AS <br />FOLLOWS: <br />1126.10 EXPIRATION OF APPROVAL AND EXTENSION OF TIME. <br />After any development plan or application for a building permit has been finally approved <br />by Council, or approved with respect to a"minor change" as provided for in Section <br />1126.08, the applicant shall take all necessary steps and meet all legal requirements in <br />order to timely obtain a building permit from the Building Official. In the event that the <br />applicant fails to obtain a permit within one (1) year of final approval as set forth above, <br />the approval shall expire unless the Director of Planning and Development, upon <br />timely application, administrativelv extends for a period of up to one (1) vear the <br />previous approval rendered bv the Council or the Director of Planning and <br />Development pursuant to Section 1126.08. Such application shall be approved unless <br />one of the followinz circumstances are present: <br />1. The applicable zoning reeulations have been amended; or <br />2. Tlie eactension of time is based upon a new developinent plan or an <br />amendrnent to the final, approved development plan: or <br />3. The propertv has been cited bv the Buildinz Offcial for any <br />buildinQ, zoning or real propertv maintenance code violation and <br />the violation remains outstandinQ at the time of application. <br />The failure of the Director to lZrant such request is final and not subiect to review. <br />SECTION 2: Any other Ordinance, or part of Ordinance, which is inconsistent or in <br />conflict with any of the provisions of this Ordinance is, to the extent of any such inconsistency or <br />conflict, hereby repealed. <br />SECTION 3: That this Ordinance shall take effect and be in force from and after <br />the earliest period allowed by law as specified in the Charter of the City of North Olmsted. <br />2
