CITY OF NORTH OLMSTED ORDINANCE NO. 2010 - 153 BY: Mayor Kennedy AN ORDINANCE DISPENSING WITH A FORMAL RFP PROCESS AND A UTHORIZING THE MA YOR TO ENTER INTO A CONTRACT WITH HAZEN AND SAWYER, P.C. TO PROVIDE CONTINUED ENGINEERING DESIGN AND OTHER RELATED PROFESSIONAL SERVICES TO THE CITY OF NORTH OLMSTED IN CONNECTION WITH PROPOSED IMPROVEMENTS TO THE WASTEWATER TREATMENT PLANT AND COLLECTIONS SYSTEM, AND DECLARING AN EMERGENCY. WHEREAS, this Council on November 15, 2005, adopted Ordinance No. 2005-167 authorizing the Director of Public Service to request proposals from qualifying consulting engineer firms to conduct a rate and operations study of the North Olmsted Wastewater Treatment Plant and Collections System; and WHEREAS, proposals were thereafter submitted by various consulting engineering firms and, on July 25, 2006, the City's Board of Control awarded a contract to ATS Engineering, Inc., as the firm most qualified to conduct the rate and operations study for the City; and WHEREAS, in the years 2006-2007, ATS Engineering, Inc. comprehensively studied and reviewed the rate structure and operations of the Wastewater Treatment Plant and Collections System, and, on September 12, 2007, presented to this City Council its formal report which recommended an increase in user charges, plant operational changes, and various improvements to the Wastewater Treatment Plant and Collections System; and WHEREAS, based on the recommendations of the Administration and ATS Engineering, Inc., this Council, on November 20, 2007, adopted Ordinance No. 2007-123, which provided for an increase in user charges effective January l, 2008; and WHEREAS, the City via 2008-9 authorized additional consulting engineer firm services with ATS Engineering, Inc. in order to provide engineering design and other related professional services to the City in connection with the above referenced proposed improvements to the Wastewater Treatment Plant and Collections System; and WHEREAS, on the 8t" day of April, 2009, the Corrected Copy of the Agreement authorized by 2008-9 was entered into with ATS Engineering, Inc., a copy of which is attached hereto as Exhibit A; and WHEREAS, since April of 2009, Hazen and Sawyer, P.C. is the assignee / successor entity to ATS Engineering, Inc.; and WHEREAS, the City is in need of additional / continued engineering design services with Hazen and Sawyer, P.C., as the work upon the proposed renovations to the Waste Water Treatment Plant and Collection Systems continues; and
