WHEREAS, Section 111.08 of the Administrative Code provides that personal services, including professional services, may be obtained by the City without following the formal RFP process established by Section 111.03 et seq. of the Administrative Code, when it is beneficial to do so due to a continuing relationship between the City and a professional services provider; and WHEREAS, it is accordingly the recommendation of the Director of Public Service and the desire of this Council, in light of the continuing professional relationship between the City and Hazen and Sawyer, P.C., to dispense with the RFP process and authorize the Mayor to enter into a contract with Hazen and Sawyer. P.C., for the purpose of providing the engineering design and other related professional services needed for the proposed improvements to the Wastewater Treatment Plant and Collections System; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the formal RFP process required by Sections 111.03 et seq. of the Administrative Code is hereby dispensed with by reason of the continuing professional relationship between the City and Hazen and Sawyer, P.C., and the Mayor be and he hereby is authorized to enter into a contract with Hazen and Sawyer, P.C., to provide engineering design and other related professional services for the proposed improvements to the North Olmsted Wastewater Treatment Plant and Collections System. SECTION 2: That said contract shall be in a final form and substance substantially the same as the Professional Services Agreement attached to this Ordinance as "Exhibit B," to which is attached the proposal of Hazen and Sawyer, P.C., dated , 20 , with only such changes thereto in the form and substance of the Agreement and Proposal that are not substantially adverse to the City. The character of any such changes as not being substantially adverse to the City shall be evidenced conclusively by the execution of the Agreement by the Mayor and the approval of the Agreement by the Director of Law. SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the reason that this legislation must go into effect immediately in order to address I/I problems in the Collections System as quickly as possible and to adhere to timelines set far the City by the Ohio EPA; and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
