WHEREAS, Section 111.08 of the Administrative Code provides that personal <br />services, including professional services, may be obtained by the City without following the <br />formal RFP process established by Section 111.03 et seq. of the Administrative Code, when it <br />is beneficial to do so due to a continuing relationship between the City and a professional <br />services provider; and <br />WHEREAS, it is accordingly the recommendation of the Director of Public Service <br />and the desire of this Council, in light of the continuing professional relationship between the <br />City and Hazen and Sawyer, P.C., to dispense with the RFP process and authorize the Mayor <br />to enter into a contract with Hazen and Sawyer. P.C., for the purpose of providing the <br />engineering design and other related professional services needed for the proposed <br />improvements to the Wastewater Treatment Plant and Collections System; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the formal RFP process required by Sections 111.03 et seq. of the <br />Administrative Code is hereby dispensed with by reason of the continuing professional <br />relationship between the City and Hazen and Sawyer, P.C., and the Mayor be and he hereby is <br />authorized to enter into a contract with Hazen and Sawyer, P.C., to provide engineering <br />design and other related professional services for the proposed improvements to the North <br />Olmsted Wastewater Treatment Plant and Collections System. <br />SECTION 2: That said contract shall be in a final form and substance substantially <br />the same as the Professional Services Agreement attached to this Ordinance as "Exhibit B," to <br />which is attached the proposal of Hazen and Sawyer, P.C., dated , 20 , with <br />only such changes thereto in the form and substance of the Agreement and Proposal that are <br />not substantially adverse to the City. The character of any such changes as not being <br />substantially adverse to the City shall be evidenced conclusively by the execution of the <br />Agreement by the Mayor and the approval of the Agreement by the Director of Law. <br />SECTION 3: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare, and for <br />the reason that this legislation must go into effect immediately in order to address I/I problems <br />in the Collections System as quickly as possible and to adhere to timelines set far the City by <br />the Ohio EPA; and further provided it receives the affirmative vote of two-thirds of all <br />members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />PASSED: &Ujjj&, (-`--- <br />FirstReading: Ll <br />Second Reading: ??'? <br />Third Reading.• f`? ?IIWr`f" <br />Committee: ?h:q (kk <br />ATTEST: <br />+ ?-r <br />MARIE GALLO <br />Clerk of Council <br />?- <br />?- •? ?"C?--°-/ ,1 --?-?--r?---?--? <br />, <br />DUANE K LIMPERT ? <br />President of Council <br />2
