<br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2006 - 95 <br />BY: Mayor O'Grady <br /> <br />AN ORDINANCE ACCEPTING SEPARATE EASEMENTS TO THE <br />CITY OF NORTH FOR A STORM WATER DRAINAGE SYSTEMAND <br />FOR A CCESS TO A STORM WATER RETENTION BASIN, AS WELL <br />AS ENTERING INTO A DECLARATION OF PROTECTIVE <br />COVENANTS TO BENEFIT THE CITY, FOR VIENNA WOODS <br />SUBDIVISION. <br />WHEREAS, the preliminary plan approval for the Vienna Woods Subdivision regt~~.ced <br />reference to a separate parcel of property to serve as a storm water retention basin, subject to the <br />imposition of Protective Covenants to benefit the City of North Olmsted, and conditioned upon an <br />access easement granted to the City of North Olmsted; and <br />WHEREAS, Elmer S. Kadar, has proposed to construct a storm water retention basin to <br />service the Vienna Woods Subdivision and offers an Access Easement for and a Protective Covenant <br />to secure its separate storm water retention basin; and <br />WHEREAS, Vienna Construction Company has proposed to develop the Vienna Woods <br />Subdivision and offers an Easement to the City of North Olmsted for its storm sewer drainage <br />system; and <br />WHEREAS, it is the desire of this Council to authorize the Mayor, on behalf of the City, to <br />accept said Easements and Protective Covenant so that the City may control and, if necessary, access <br />the storm sewer drainage system and water retention basin; and <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION 1: That the Mayor is hereby authorized to accept, on behalf of the City of North <br />Olmsted, from Vienna Construction Company, the owner of certain real property as located and <br />described on the Easement attached hereto as Exhibit A, a storm sewer easement to the North <br />Olmsted, Ohio. A copy of said Easement, which the Mayor is authorized to accept on behalf of the <br />City, is attached as Exhibit A and made a part hereof as though fully rewritten herein. <br />1 <br />
