~_e,. SECTION 2: That the Mayor is hereby authorized to accept, on behalf of the City of North Olmsted, from Elmer S. Kadar, the owner of certain real property as located and described on the Access Easement attached hereto as Exhibit B, a water retention access easement to the North Olmsted, Ohio. A copy of said Access Easement, which the Mayor is authorized to accept on behalf of the City, is attached as Exhibit B and made a part hereof as though fully rewritten herein. SECTION 3: That the Mayor is hereby authorized to enter into and accept from, on behalf of the City of North Olmsted, Elmer S. Kadar, the owner of certain real property as located and described on two separate documents, attached hereto as Exhibits C and D, entitled Termination of Protective Covenant and Declaration of Protective Covenant, to thereby amend and to reimpose upon said property, that being the location of the water retention basin, various deed restriction for the benefit of the City. A copy of said Termination of Protective Covenant and Declaration of Protective Covenant, which the Mayor is authorized to enter and accept on behalf of the City, is attached as Exhibits C and D, and made a part hereof as though fully rewritten herein. SECTION 4: That the Engineer of the City of North Olmsted is hereby directed to cause said separate easements and covenant documents to be recorded in the office of the Cuyahoga County Recorder. SECTION 5: That this Ordinance shall take effect and be in force from and after the eat,~est period allowed by law.
