G I / q l0 7 AN ORDINANCE PROVIDING FOR THE SUBMISSION TO THE ELECTORS OF THE CITY OF NORTH OLMSTED OF AN AMENDMENT TO ARTICLE III, SECTION S(b) OF THE CHARTER OF THE CITY OF NORTH OLMSTED TO ELIMINATE THE MAYOR'S PART OR ITEM VETO OVER ANY RESOLUTION OR ORDINANCE APPROPRIATING MONEY. WHEREAS, because the budget is one document with all amounts determined as related to each other and all departments should have equal consideration in setting the budget so that it is necessary that all work together; and WHEREAS, it is the desire of this Council to submit to the voters of North Olmsted a proposal to amend Article III, Section 5(b) of the Charter of the City of North Olmsted so as to eliminate the Mayor's part or item veto over any resolution or ordinance appropriating money; and WHEREAS, this proposal was submitted by this Council to the Charter Review Commission for review and recommendation in accordance with Article XIV, Section (b)(2 of the City Charter, and, within 60 days of the date of referral, the Commission on the ` day of , 2006, filed a written report with the Clerk of Council in which the Commission stated tha , by a 3 to ~ vote, a motion to recommend approval of the proposal (~,asse'c) (failed); and WHEREAS, this Council has adopted this Ordinance, as required by state law, no sooner than 120 days, and no later than 60 days, prior to the date of the election at which the issue will be voted upon by the electorate; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTHOLMSTED, COUNTYOF CUYAHOGA, OHIO, TWO-THIRDS OFALL MEMBERS CONCURRING THAT: SECTION 1. Pursuant to Article XVIII, Sections 9 of the Ohio Constitution, and Article XII of the Charter of the City of North Olmsted, this Council authorizes and directs that the following proposal to amend the Charter of the City of North Olmsted be submitted to the electors of the City of North Olmsted at the regular election to be held at the usual places of voting in the City on Tuesday, November 6, 2006: That Article III, Section 5(b) of the Charter of the City of North Olmsted be amended so as to eliminate the Mayor's part or item veto over any resolution or ordinance appropriating money: ARTICLE III SECTION 5. DUTIES AND POWERS OF THE MAYOR (b) Legislative Powers. Every ordinance passed or resolution adopted by the Council shall be attested by the Clerk of Council and promptly presented to the Mayor. If the Mayor approves such ordinance or resolution, he shall sign it within ten (10) days after its passage or adoption by the Council, but if he does not approve it, he shall return it to the Council with
