,~,,, Ordinance No. 2006-59 SECTION 2: That the original section 1305.05 amended or revised herein is expressly repealed and all other ordinances or parts of ordinances or resolutions that are inconsistent or in conflict with the newly amended section 1305.05 of Chapter 1305 are likewise repealed to the extent of such inconsistency or conflict only. SECTION 3: That, in all other respects, the North Olmsted Building Code, as amended and supplemented from time to time, shall remain in full force and effect. SECTION 4: That, if any section, paragraph, sentence, clause, phrase, term, provision or part of this Ordinance shall be adjudged by any court of competent jurisdiction to be invalid or inoperative, such judgment shall not affect, impair or invalidate the remainder thereof, but shall be confined in its operation to the section, paragraph, sentence, clause, phrase, term, provision or part thereof directly involved in the controversy in which such judgment shall have been rendered. SECTION 5: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and for the further reason that it is necessary that this legislation go into effect immediately to address a deficiency in the Building Code that causes substantial economic hardship to city residents without demonstrating a substantial benefit, and further provided it receives the affirmative vote oftwo-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
