,~,,, <br />Ordinance No. 2006-59 <br />SECTION 2: That the original section 1305.05 amended or revised herein is <br />expressly repealed and all other ordinances or parts of ordinances or resolutions that are <br />inconsistent or in conflict with the newly amended section 1305.05 of Chapter 1305 are <br />likewise repealed to the extent of such inconsistency or conflict only. <br />SECTION 3: That, in all other respects, the North Olmsted Building Code, as <br />amended and supplemented from time to time, shall remain in full force and effect. <br />SECTION 4: That, if any section, paragraph, sentence, clause, phrase, term, <br />provision or part of this Ordinance shall be adjudged by any court of competent <br />jurisdiction to be invalid or inoperative, such judgment shall not affect, impair or <br />invalidate the remainder thereof, but shall be confined in its operation to the section, <br />paragraph, sentence, clause, phrase, term, provision or part thereof directly involved in <br />the controversy in which such judgment shall have been rendered. <br />SECTION 5: That this Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, safety and <br />welfare, and for the further reason that it is necessary that this legislation go into effect <br />immediately to address a deficiency in the Building Code that causes substantial <br />economic hardship to city residents without demonstrating a substantial benefit, and <br />further provided it receives the affirmative vote oftwo-thirds of all members of Council, <br />it shall take effect and be in force immediately upon its passage and approval by the <br />Mayor. <br />PASSED: ~/ ~ O4 ~ 02 /ai ~ G <br />ATTEST.• <br />c.,~~ <br />ARBARA L.
