p ;,. <br />~~,t <br /> <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0.2006 -16 <br />BY: Mayor O'Grady <br />..;-t.2, <br />AN ORDINANCE CONTROLLING POST-CONSTRUCTION <br />STORM WATER RUNOFF QUALITY IN AN EFFORT TO <br />IMPROVE THE QUALITY OF WATER IN THE RIVERS, <br />STREAMS, PONDS AND LAKES WITHIN THE VARIOUS <br />WATERSHEDS IN THE CITY OF NORTH OLMSTED, AND <br />DECLARING AN EMERGENCY, AS AMENDED. <br />WHEREAS, flooding and streambank erosion in the City of North Olmsted are a <br />significant threat to public health and safety and public and private property, and storm water <br />quantity control slows runoff and reduces its erosive force, and flood damage; and, <br />WHEREAS, insufficient quality of storm water runoff can result in significant damage to <br />receiving water resources, impairing the capacity of these resources to sustain aquatic systems <br />and their associated aquatic life use designations; and, <br />WHEREAS, there is a regional effort to improve the quality of water in the rivers, <br />streams, ponds, and lakes within various watersheds in northeast Ohio and to protect and <br />enhance the water resources of northeast Ohio, and the City of North Olmsted recognizes its <br />obligation as a part of a watershed and the region to protect water quality by controlling runoff <br />within its borders; and, <br />WHEREAS, the City of North Olmsted has experienced and continues to experience <br />significant costs associated with inadequate surface water quality including legal fees, <br />engineering services, and increased state and federal regulation; and, <br />WHEREAS, Title 40 Codified Federal Register (C.F.R.) Parts 9, 122, 123, and 124, <br />referred to as NPDES Storm Water Phase II, require designated communities, including the City <br />of North Olmsted, to develop a Storm Water Management Program to address the quality of <br />storm water runoff, among other components, during and after soil disturbing activities; and, <br />WHEREAS, Article XVIII, Section 3 of the Ohio Constitution and Chapter 1511 of the <br />Ohio Revised Code grants municipalities the legal authority to adopt rules to abate water <br />pollution by soil sediments; and, <br />WHEREAS, to promote public health and safety and sound economic development ire the <br />City of North Olmsted, it is important to provide homebuilders, developers, and landowners with <br />consistent, technically feasible, and operationally practical standards for water quality runoff <br />management; and, <br />
