Ordinance No. 2006-16 WHEREAS, acting in accordance with the foregoing, and upon the recommendation of the City Engineering Department, it is desire of this Council to adopt regulations to control post- construction storm water quality for new developments in the City of North Olmsted; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That there is hereby created new Chapter 928 of the North Olmsted Streets, Utilities and Public Services Code, entitled "Post-Construction Storm Water Management Regulations," which, as created, shall read in its entirety as set forth in Exhibit A attached to this Ordinance, and is expressly incorporated into this Ordinance as if fully rewritten herein. SECTION 2: That any ordinance or resolution, or any part of any ordinance or resolution, that is inconsistent or in conflict with any provision of this Ordinance, shall be, to the extent or any such inconsistency or conflict, repealed. SECTION 3: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare, and further for the reason that it is necessary that this Ordinance go into effect immediately because of federal regulations that require an effective date in March 2006; and further provided it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
