<br /> <br />c <br />~,~,o <br />CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2006 - 7 <br />BY: Council Members Gareau, Orlowski and Dailey Jones <br />AN ORDINANCE AMENDING SECTION 1126.03 OF THE ZONING <br />CODE IN ORDER TO ADD STORM AND SANITARY SEWER <br />CERTIFICATION REQUIREMENTS TO THE DEVELOPMENT <br />PLAN SUBMITTAL REQUIREMENTS FOR COMMERCIAL <br />DEVELOPERS. <br />WHEREAS, Section 1126.03 requires that commercial developers, in submitting <br />proposed development plans to the Director of Planning and the Building Official, <br />include certain items therein to assist the City in evaluating the development proposal for <br />compliance with the City's various applicable codes; and <br />WHEREAS, it is the desire of this Council to amend said Section 1126.03 so as to <br />additionally require that commercial developers also include in such submittals <br />certification from a qualified engineer that existing sanitary and storm improvements <br />proposed to be used in their development or re-development have been installed as <br />originally approved by the City and are in good and working condition; and <br />WHEREAS, the Planning & Design Commission on the ~ day of <br />^° , 2006, by formal motion, (recommended -~ did n t r~jcommend) that <br />t is Ordinance be adopted; and ~-~-~~' `~~`'`~'~ ~~~/ 06 <br />WHEREAS, following publication of newspaper notice in conformance with the <br />provisions of Section 14 of Article IV of the Charter of the City of North Olmsted and <br />Section 1127.03 of the North Olmsted Zoning Code, a public hearing was held on this <br />proposed legislation on the day of , 2006; <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLMSTED, COUNTY OF CUYAHOGA, STATE OF OHIO: <br />SECTION 1: That Section 1126.03 of the Zoning Code, which presently reads as <br />follows: <br />"1126.03 DEVELOPMENT PLAN REQUIREMENTS. <br />All development plans or parts thereof shall be prepared and submitted by a state <br />licensed/registered professional such as an engineer, surveyor or architect. The <br />development plans shall include all of the following items, unless waived by the Director <br />of Planning and/or Building Official. <br />
