~ r CITY OF NORTH OLMSTED, OHIO s~~ ORDINANCE N0. 77 - 9 BY: AN 0 INANCE AMENDING SUBSECTION 913.117(b) ENTITLED "SCHEDULE OF TAP-IN CHARGES BASED ON BENEFITED UNITS" OF SECTION 913.117 ENTITLED "SEWER CONNECTIONS: TAP-IN PERMIT, FEE AND PENALTY" OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED, AND DECLARING AN EMERGENCY. WHEREAS, this Council has determined that the tap-in charges established are insufficient and do not reflect actual benefits derived and it is the desire of this Council to up-grade said tap- in charges to bring them more into line with the current economic conditions. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That Subsection 913.117(b) entitled "Schedule of Tap-In Charges based on Benefited Units" of Section 913.117 entitled "Sewer Connections: Tap-In Permit, Fee and Penalty" of the Codified Ordinances of the City of North Olmsted, which now reads as follows: "(b) Schedule of Tap-In Charges Based on Benefited Units. The Director of Public Service shall not issue a permit- owe purpose described in subsection (a) hereof until the applicant therefor has paid a tap-in charge to be determined in accordance with the following: If Permit Obtained: Benefited Unit of One On or before December 31, 1974 $290.00 From January 1, 1975 to December 31, 1979 325.00 From January 1, 1980 to December 31, 1984 370.00 From January 1, 1985 and thereafter 420.00 Such incremental charges are designed to offset in part the interest costs incurred by the City in issuing notes and bonds and the loan from the Ohio Water Development Authority to pay the cost of construct- ing improvements and extensions to the sewerage system which were not recovered by special assessments. Definition of Benefited Units Single-Family Residence 1 Apartments: Efficiency and one bedroom Number of apartment units x .5 Two bedroom Number of apartment units x .75 Three bedroom and over Number of apartment units x 1.0 The number of benefited units to be assigned to nonresidential buildings, structures or other facilities shall be determined by the Director of Public Service in the following manner. The Director of Public Service shall review the preliminary plans of the building, structure or other facility to be served by the connection, together with other pertinent information, and based upon accepted engineering practices determine the estimated average daily quantity of sewage to be discharged from such building, structure or other facility to the sanitary sewer system. The quantity so determined shall then be divided by the estimated average daily quantity of sewage discharged from a single-family residence and the resulting quotient carried out to the nearest one-hundredth shall be the number of benefited units assigned to such building, structure or other facility. The tap-in charge will then be calculated by multiplying the number of benefited units by the rate per unit applicable at such time."
