~ r <br />CITY OF NORTH OLMSTED, OHIO <br />s~~ <br />ORDINANCE N0. 77 - 9 <br />BY: <br />AN 0 INANCE AMENDING SUBSECTION 913.117(b) <br />ENTITLED "SCHEDULE OF TAP-IN CHARGES BASED <br />ON BENEFITED UNITS" OF SECTION 913.117 <br />ENTITLED "SEWER CONNECTIONS: TAP-IN PERMIT, <br />FEE AND PENALTY" OF THE CODIFIED ORDINANCES <br />OF THE CITY OF NORTH OLMSTED, AND DECLARING <br />AN EMERGENCY. <br />WHEREAS, this Council has determined that the tap-in charges <br />established are insufficient and do not reflect actual benefits <br />derived and it is the desire of this Council to up-grade said tap- <br />in charges to bring them more into line with the current economic <br />conditions. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That Subsection 913.117(b) entitled "Schedule of <br />Tap-In Charges based on Benefited Units" of Section 913.117 entitled <br />"Sewer Connections: Tap-In Permit, Fee and Penalty" of the Codified <br />Ordinances of the City of North Olmsted, which now reads as follows: <br />"(b) Schedule of Tap-In Charges Based on Benefited Units. The <br />Director of Public Service shall not issue a permit- owe purpose <br />described in subsection (a) hereof until the applicant therefor has <br />paid a tap-in charge to be determined in accordance with the following: <br />If Permit Obtained: <br />Benefited Unit of One <br />On or before December 31, 1974 $290.00 <br />From January 1, 1975 to December 31, 1979 325.00 <br />From January 1, 1980 to December 31, 1984 370.00 <br />From January 1, 1985 and thereafter 420.00 <br />Such incremental charges are designed to offset in part the interest <br />costs incurred by the City in issuing notes and bonds and the loan <br />from the Ohio Water Development Authority to pay the cost of construct- <br />ing improvements and extensions to the sewerage system which were not <br />recovered by special assessments. <br />Definition of Benefited Units <br />Single-Family Residence 1 <br />Apartments: <br />Efficiency and one bedroom Number of apartment units x .5 <br />Two bedroom Number of apartment units x .75 <br />Three bedroom and over Number of apartment units x 1.0 <br />The number of benefited units to be assigned to nonresidential buildings, <br />structures or other facilities shall be determined by the Director of <br />Public Service in the following manner. The Director of Public Service <br />shall review the preliminary plans of the building, structure or other <br />facility to be served by the connection, together with other pertinent <br />information, and based upon accepted engineering practices determine <br />the estimated average daily quantity of sewage to be discharged from <br />such building, structure or other facility to the sanitary sewer system. <br />The quantity so determined shall then be divided by the estimated <br />average daily quantity of sewage discharged from a single-family residence <br />and the resulting quotient carried out to the nearest one-hundredth <br />shall be the number of benefited units assigned to such building, <br />structure or other facility. The tap-in charge will then be calculated <br />by multiplying the number of benefited units by the rate per unit <br />applicable at such time." <br />
