CITY OF NORTH OLl!7STED, OHIO ORDINANCE N0. 77 - 179 BY : Mr _ Wil am~Sk~ AN ORDINANCE AUTHORIZING THE MAYOR TO PURCHASE JOINTLY WITH THE NORTH OLMSTED BOARD OF EDUCATION CERTAIN PROPERTY LOCATED ON STEARNS ROAD OWNED BY JOHN P. AND JANE L. D4ARINER, AND DECLARING AN EMERGENCY. WHEREAS, this Council has heretofore authorized the Mayor to negotiate for the purchase of two parcels owned by John P. and Jane L. Mariner, said parcels being Permanent Parcel Nos. 234-22-22 and 234-22-23 located fronting on Stearns Road, and WHEREAS, the City and the Mariners have reached an agreement and it is the desire of this Council to have the City enter into a formal agreement for the purchase of said land, and WHEREAS, it is the intention of the City to take title to the aforesaid property jointly with the North Olmsted Board of Education, with each party paying one-half of the costs. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLP.~STED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That the Mayor be and he is hereby authorized to enter into an agreement with John P. and Jane L. Mariner for the purchase of Permanent Parcels Nos. 234-22-22 and 234-22-23 which are located fronting on .Stearns Road, a copy of which agreement is attached hereto and made a part hereof as though fully rewritten herein and marked Exhibit "A". SECTION 2: That the Mayor be and he is hereby authorized to enter into an Agreement with the North Olmsted Board of Education for the joint purchase of the aforesaid land. SECTION 3: That the Mayor be and he is further authorized to assign a portion of its interests to the Board of Education with respect to the purchase agreement as specified in Section 1 hereof. SECTION 4: That the Director of Finance be and he is hereby authorized to pay to John P. and Jayne L. Mariner the sum of Four Thousand Three Hundred Dollars ($4,300.00) upon the completion of escrow with respect to the subject purchase of property. SECTION 5: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare and for the further reason that it is immediately necessary to obtain recreation land for the residents of North Olmsted, and further provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
