>~/~9 <br />PURCHASE AGREEMENT <br />THIS AGREEMENT made this.___ day of <br />1977 <br />by and between the CITY OF NORTH OLMSTED, OHIO, hereinafter <br />~icalled "Purchaser", and JOHN P. and JANE L. MARINER, hereinafter <br />.called "Sellers": <br />WHEREAS, Sellers are the owners of Permanent Parcel Nos. <br />234-22-22 and 234-22-23 which are land-locked parcels resultant <br />from the State of Ohio's Department of Transportation having <br />purchased the property fronting on McKenzie Road, and <br />WHEREAS, it is the desire of the City of North Olmsted <br />to purchase said property upon the terms and conditions hereinafte <br />Iset forth: <br />1. Purchaser hereby agrees to purchase the parcels known <br />as Permanent Parcel Nos. 234-22-22 and 234-22-23, being further <br />',described in Exhibit "A" which is attached hereto-and made a <br />part hereof as though fully rewritten herein. <br />2. As consideration for the purchase of said property, <br />Purchaser agrees to pay to Sellers the sum of Eight Thousand <br />Six Hundred Dollars ($8,600.00) payable as follows: <br />a) $100.00 earnest money in hand paid, the <br />receipt of which Sellers hereby acknowledge; <br />b) $8,500.00 to be placed in escrow. <br />3. Sellers agree to deliver to the Purchaser or its <br />nominee, a good and sufficient Warranty Deed conveying title free <br />and clear of all liens, encumbrances, exceptions and reservations, <br />except those liens and encumbrances which are of record, as well <br />as taxes for the first half of 1977. <br />4. All funds and documents shall be placed in escrow with <br />Chicago Title Insurance Company within sixty (60) days of the <br />date of this Agreement.
