Grantors claim title by instrument(s) of record in Volume Page County Recorder's Office. TO HAVE AND TO HOLD unto the said Grantee, its suc- cessors and assigns, upon the condition that the Grantee, by acceptance of this Easement for Channel Purposes, assumes all liability and responsibility for the maintenance, repair, and improvement of such perpetual watercourse, ditch, channel or other drainage facility constructed in, on, upon, and over the hereinabove-described lands to the extent that such maintenance or repair is not caused by any negligent act or omission of the Grantors, their respective successors or assigns. And the said Grantors, for themselves and their suc- cessors and assigns, do hereby covenant with the said Grantee, its successors and assigns, that they are the true and lawful owners of the said premises, and have full power to convey the same; that the easement so conveyed is subject to all zoning restrictions and utility easements of record, and that they do Warrant and will Defend the same against all claims of all persons whomsoever except as aforesaid. IN WITNESS WHEREOF, said Board of Education of the North Olmsted City School District and the City of North Olmsted, through the undersigned who were duly authorized, have signed this Deed, this day of _ 1977.
