similar position if his former position no longer <br />exists if he is physically qualified for the job. <br />In the event the City questions whether the <br />employee is physically able to do the work, it will <br />require the employee to furnish a medical certificate <br />of a physician supporting his claim of fitness, and <br />the City shall have the right to have the employee <br />examined by a doctor of its choice. If disagreement <br />thereafter exists, a third physician shall be <br />mutually selected by the Union and the City to determine <br />the issue, and the opinion of the third physician <br />shall be final on the parties. The charges made by <br />the third physician shall be shared equally by the <br />City and the Union. <br />(d) No more than one member of any Wastewater Treatment <br />shift crew may be absent on school leave or for <br />certification tests at any time. Seniority will <br />govern. The second man will make special arrange- <br />ments suitable to the Superintendent. <br />38. If it is found that a leave of absence is not actually <br />being used for the purpose-for which it was granted, the City shall <br />cancel the leave and it may impose disciplinary action up to and <br />including discharge. <br />-2 3- <br />
