Nothing herein shall <br />prevent individual employees from discussing terms and conditions <br />of employment now covered by this Memorandum with the City, however, <br />such communication shall not be used to undermine the position of <br />the Union as the representative of the employees. <br />NON-DISCRIMINATION <br />3. Both the City and the Union recognize their respective <br />responsibilities under the federal and state civil rights laws, fair <br />employment practice acts and other similar constitutional and statutory <br />requirements. Therefore, both the City and the Union hereby re- <br />affirm their commitments, legal and moral, not to discriminate in any <br />manner relating to employment on the basis of race, color, creed, <br />national origin, sex, age, or any other invidious reason. <br />4. The City recognizes the right of all employees and all appli- <br />cants for employment to be free to join the Union and participate in <br />lawful, concerted Union activities. Therefore, the City agrees that <br />there shall be no discrimination, interference, restraint, coercion, <br />or reprisal by the City against any employee or any applicant for <br />employment because of Union membership or because of any lawful <br />activity in an official capacity on behalf of the Union.
