WITNESSETH: WHEREAS, the COUNTY and the MUNICIPALITY have mutually agreed by and between themselves to increase the structural adequacy of pavement on CLAGUE ROAD, a municipal street and also a county road in the CITY of NORTH OLMSTED by applying an overlay of asphalt concrete from LORAIN ROAD to NORTH OLMSTED N. CORP. LINE and adjust castings to grade where necessary, all in accordance with plans, specifications and estimates as approved by the Cuyahoga County Engineer; and WHEREAS, current Cuyahoga County Engineer standards for construction of County Roads shall be utilized in the design of this project; and WHEREAS, it is understood that the municipality has an option to expedite the project by undertaking the project engineering and specifications at its own expense; and, in the case of a project involving multi-municipalities the engineering costs will be shared in proportion to the percentage of roadway located within each municipality; and WHEREAS, Federal-Aid Highway Funds and/or State Issue No. 1 Funds will be requested from the Ohio Department of Transportation, Administrator of such funds to cover eligible costs of this improvement; and on the condition that the application is etermined to be ineligible for federal funding, this office will valuate the project for possible local County funding; and WHEREAS, the Board of County Commissioners, as Administrator f the County Motor Vehicle S5, 00 License Tax Fund may, upon pproval of an application from the MUNICIPALITY reruesting such unds, authorize an allocation of the aforesaid funds to the UNICIPALITY to pay that MUNICIPALITY'S share of cooperating ith the COUNTY in the road improvement project; and NOW THEREFORE, in accordance with the erein contained to be performed by the ayments hereinafter agreed to be paid, etween the parties hereto as follows: covenants and agreements parties hereto and the it is mutually agreed (1)
