t'"° <br />A G R E E M E N T <br />..~' <br />Between the Board of County Commissioners of <br />Cuyahoga County, and the CITY of NORTH OLMSTED <br />to increase the structural adeouacy of pavement on <br />CLAGUE ROAD (CR-052) <br />by applying an overlay of asphalt concrete from <br />LORAIN ROAD to NORTH OLMSTED NORTH CORPORATION LINE <br />This agre~e~nenf "entered into at Cleveland, Ohio this _ _ __ <br />day of _ _ _ _ ___, 1977, by and between the County of <br />Cuyahoga, Ohio,~by its Board of County Commissioners, Party of <br />the First Part and hereinafter referred to as the COUNTY and the <br />CITY of NORTH OLMSTED by its MAYOR having been dul y ~" "~"~"" "" -'" <br />authorized to enter into said agreement by Ordinance No._7.7_-166____ <br />adopted"by~"the "Coupe i 1 of "fh~e'C ITY of NORTH OLMSTED <br />on the _.4th day of october___ __ 1977, Party of the Second <br />Part and hereinafter referred to as the MUNICIPALITY. <br />WITNESSETH: <br />WHEREAS, the COUNTY and the MUNICIPALITY have mutually agreed <br />by and between themselves to increase the structural adequacy of <br />pavement on CLAGUE ROAD, a municipal street <br />and also a county road in the CITY of NORTH OLMSTED by <br />applying an overlay of asphalt concrete from LORAIN ROAD to NORTH <br />OLMSTED N. CORP. LINE and adjust castings to grade where necessary, <br />all in accordance with plans, specifications and estimates as <br />approved by the Cuyahoga County Engineer; and <br />WHEREAS, current Cuyahoga County Engineer standards for <br />construction of County Roads shall be utilized in the design of <br />this project; and <br />WHEREAS, it is understood that the municipality has an option <br />to expedite the project by undertaking the project engineering <br />and specifications at its own expense; and, in the case of a <br />project involving multi-municipalities the engineering costs will <br />be shared in proportion to the percentage of roadway located <br />within each municipality; and <br />WHEREAS, Federal-Aid Highway Funds and/or State Issue No. 1 <br />Funds will be requested from the Ohio Department of Transportation, <br />Administrator of such funds to cover eligible costs of this <br />improvement; and on the condition that the application is <br />etermined to be ineligible for federal funding, this office will <br />valuate the project for possible local County funding; and <br />WHEREAS, the Board of County Commissioners, as Administrator <br />f the County Motor Vehicle S5, 00 License Tax Fund may, upon <br />pproval of an application from the MUNICIPALITY reruesting such <br />unds, authorize an allocation of the aforesaid funds to the <br />UNICIPALITY to pay that MUNICIPALITY'S share of cooperating <br />ith the COUNTY in the road improvement project; and <br />NOW THEREFORE, in accordance with the <br />erein contained to be performed by the <br />ayments hereinafter agreed to be paid, <br />etween the parties hereto as follows: <br />covenants and agreements <br />parties hereto and the <br />it is mutually agreed <br />(1) <br />
