^~ ~^ ''"*~ .~ (F) No rule or regulation shall be enacted restricting the use of the improved road andlor structure by any class of vehicle or vehicle load permitted by the Ohio Revised Code to use a public highway; any existing rule or regulation so restricting road usage shall be rescinded. EVENTH: That the MUNICIPALITY shall prohibit pavement opening in the pavement constructed under this contract, except for emergency or necessary repairs to existing utility. installations, fora period of five (5) years after completion of the project. IGHTH: That the MUNICIPALITY further agrees that if at some time in the future the COUNTY determines to cease the maintenance of the completed roadway, the following provisions will be binding: The MUNICIPALITY will maintain the road in a satisfactory condition from the date the COUNTY ceases its maintenance. The County Engineer will make periodic inspections from the date the MUNICIPALITY assumes maintenance and will notify the MUNICIPALITY as to any necessary repairs which are reouired to keep the road in serviceable condition. For a period of ten (10) years after the date of the completion of the improvement the MUNICIPALITY agrees to make such repairs promptly when notified by the County Engineer that such repairs are necessary. The MUNICIPALITY also agrees that if it fails to make the necessary repairs within a reasonable time after receiving notice from the County Engineer, the COUNTY is authorised to proceed with the repair work and the MUNICIPALITY agrees to reimburse the COUNTY for any and all expenses incurred by the COUNTY in the making of said repairs.
