^~ <br />~^ ''"*~ <br />.~ <br />(F) No rule or regulation shall be enacted restricting the <br />use of the improved road andlor structure by any class <br />of vehicle or vehicle load permitted by the Ohio <br />Revised Code to use a public highway; any existing <br />rule or regulation so restricting road usage shall be <br />rescinded. <br />EVENTH: That the MUNICIPALITY shall prohibit pavement opening <br />in the pavement constructed under this contract, except <br />for emergency or necessary repairs to existing utility. <br />installations, fora period of five (5) years after <br />completion of the project. <br />IGHTH: That the MUNICIPALITY further agrees that if at some <br />time in the future the COUNTY determines to cease the <br />maintenance of the completed roadway, the following <br />provisions will be binding: The MUNICIPALITY will <br />maintain the road in a satisfactory condition from <br />the date the COUNTY ceases its maintenance. The County <br />Engineer will make periodic inspections from the date <br />the MUNICIPALITY assumes maintenance and will notify <br />the MUNICIPALITY as to any necessary repairs which are <br />reouired to keep the road in serviceable condition. <br />For a period of ten (10) years after the date of the <br />completion of the improvement the MUNICIPALITY agrees <br />to make such repairs promptly when notified by the <br />County Engineer that such repairs are necessary. The <br />MUNICIPALITY also agrees that if it fails to make the <br />necessary repairs within a reasonable time after <br />receiving notice from the County Engineer, the COUNTY <br />is authorised to proceed with the repair work and the <br />MUNICIPALITY agrees to reimburse the COUNTY for any and <br />all expenses incurred by the COUNTY in the making of <br />said repairs. <br />IN WITNESS WHEREOF, the Parties hereto have affixed their <br />ignature the day and year mentioned above <br />~ITNESSES__________.__.____.._ <br />C~ITnY of NORTH OLMSTEG <br />BOARD OF COUNTY COMMISSIONERS <br />CUYAHOGA COUNTY, OHIO <br /> <br />~3) <br />
