SHARPE AN ORDINANCE ACCEPTING AN EASEMENT FROI`4 JERRY AND IRENE MERDA FOR STORM SEWERS IN THE VICINITY OF LORAIN ROAD LOCATED WITHIN THE CITY OF NORTH OLMSTED WHEREAS, Jerry and Irene Merda have offered an easement for storm sewers over and through a parcel of land ten (10) feet in width and approximately 122 feet in length located parallel and adjacent to the southerly right-of-way line of Lorain Road and being Permanent Parcel No. 234-09-06, and WHEREAS, the City Engineer has advised the Council that it is in the best interest of the City of North Olmsted to accept an easement with respect to the storm drainage system, and i~VHEREAS, it is the desire of the City of North Olmsted and Jerry and Irene Merda to have the City's rights in said storm drainage system clearly specified and made a matter of record by recording a formal easement, and VdHEREAS, this Council deems it to be in the best interest of the City of North Olmsted to accept said easement; NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLh1STED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: That this Council does hereby accept an easement from Jerry an Irene Merda for the construction and maintenance of a storm drainage system under and on the property described in said Easement, a copy of which is attached hereto and made a part hereof as though fully rewritten herein and marked "Exhibit A". SECTION 2: That the Engineer of the City of North Olmsted is hereby irected to cause said Easement to be recorded in the office of the Recorder of Cuyahoga County.
