.. ,~, EASEMENT FOR AND IN C01dSIDERATION OF THE SUtt OF C'~I? DOLLAR paid by the City of North Olmsted, Ohio, the receipt of which is hereby ac;:rowledged, the undersigned Jerry & I. Merda do hereby grant unto the City of North Olmsted, Ohio, an easement over and through the following described lands, of which said grantor(s) warrant they are the Owners in fee simple, situated in the City of North Olmsted Countyy of Cuyahoga and State of Ohio, and identified by Permanen"t Parcel'No. ~L34-09-06 said premises having been acquired by deed dated , and recorded in Volume Page of the Cuyahoga County Record of Deeds. The easement is described as being over and through a parcel of land ten (10) feet in width and approximately 122 feet in length located parallel and adjacent to the southerly right-of-way line of Lorain Road. The above easement is identical with the sanitary sewer easement which is recorded in Volume 12550, Page 251 of Cuyahoga County Deed Records. The storm sewer is to be installed on the northerly side of the existing sanitary sewer. The above easement is granted for the purpose of constructing, maintaining and operating a storm drain, together with the necessary manholes, for the transportation of surface water i.Tith the right of unimpaired access to said storm drain the rights of intiress and egress, on, over and through said land for all purposes necessary and incident to the construction, operation and maintenance and from time, to time, alter, repair, or remove the same. The Grantor(s) herein reserve the right to fully use and enjoy said premises for all purposes consistent-with the full use and enjoyment by the grantee of the easement herein granted. The construction of structures as defined in the Grantees Building Code, except public utilities, is prohibited directly over the store drain. Grantee shall have the right to change the size of its storm drain, the damages, if any, in making such change to be paid by the grantee. After the storm drain is constructed in the above described premises, the grantee agrees to return the surface of the ground to its original elevation.
