s <br />CITY OF NORTH OLMSTED <br />RESOLUTION N0. 77-147 <br />BY: Mr. Wilamosky <br /> <br />A RESOLUTION APPROVING AN ALTERNATIVE <br />METHOD OF APPORTIONING THE UNDIVIDED LOCAL <br />GOVERNMENT FUND OF CUYAHOGA COUNTY FOR THE <br />CALENDAR YEAR 1978 AND THEREAFTER, AND <br />DECLARING AN EMERGENCY. <br />WHEREAS, the Cuyahoga County Budget Commission has been following the <br />method of apportionment of the undivided Local Government Fund of the County <br />provided in Ohio Revised Code 5747.51; and <br />WHEREAS, the Cuyahoga County Budget Commission, the Board of County <br />Commissioners, the Boards of Township Trustees, and the legislative authorities <br />of municipal corporations within the County are desirous of implementing an <br />alternative method of apportioning the Local Government Fund for the year <br />1978 and thereafter, in order to more equitably distribute the Local Government <br />Fund; and <br />WHEREAS, an alternative method of apportionment, as set forth in Exhibit <br />"A" attached and as authorized by Ohio Revised Code 5747.53, has been proposed <br />for the consideration of this body. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, <br />COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: That this Council hereby finds and determines that the <br />alternative method of apportionment of Local Government Funds set forth in <br />Exhibit "A", is objective and equitable and will exclude the limitations of <br />the present statutory formula established by Chapter 5747 of the Ohio Revised <br />Code; and, pursuant to 5747.53 of the Ohio Revised Code, this body hereby <br />adopts and approves the alternative method of apportionment as set forth in <br />Exhibit "A", and the provisions thereof are incorporatEd~~. herein and made a <br />part hereof by reference. <br />SECTION 2: That the adoption and approval of the alternate method of <br />apportionment set forth in Exhibit "A" shall be operative for funds to be <br />distributed in the year 1978 and thereafter. Such alternate method of apportion- <br />ment shall remain in full force and effect for each calendar year until revised, <br />amended, or repealed in the same manner that it has been adopted or approved. <br />In the event such alternate method of apportionment is repealed, this body authorizes <br />the undivided Local Government Fund of the County to be apportioned, commencing in <br />the calendar year following repeal, under the apportionment method provided in <br />5747.52 of the Ohio Revised Code, unless a new method for apportionment of such <br />fund is provided in the action of repeal. <br />SECTION 3: That the Clerk of Council is hereby directed to certify <br />a copy of this Resolution to the Cuyahoga County Budget Commission. <br />SECTION 4: That this resolution is hereby declared to be an emergency <br />measure, immediately necessary for the preservation of the public peace, health <br />and safety, and for the further reason that it is necessary to provide the usual <br />funds for the daily operation of the City of North Olmsted, and further provided it <br />receives the affirmative vote of two-thirds of all members elected to Council, it <br />shall take effect and be in force immediately upon its passage and approval by <br />the Mayor. <br />PASSED: ~ / 2, <br />ATTEST: <br />Nora T.
