CITY OF NORTH OLMSTED BY: ORDINANCE N0. 77 -~ 9 ~% AN ORDINANCE ACCEPTING AN EASEMENT FROM SPARTICO DiBENEDETTO and ANN DiBENEDETTO FOR A SANITARY SEWE R EASEMENT LOCATED WITHIN THE CITIES OF NORTH OLMSTED AND WESTLAKE. WHEREAS, the City of North Olmsted previously accepted an Easement from the Blossom Land Corporation for sanitary sewers located both in the City of North Olmsted and in the City of Westlake, and WHEREAS, it was determined that the easement contained an improper legal description, and WHEREAS, it is the desire of the City of North Olmsted to accept a new easement, and WHEREAS, it is the recommendation of the engineering department that the new easement be accepted, and WHEREAS, it is the desire of the City of North Olmsted and Spartico and Ann DiBenedetto, the owners of the property through which said sanitary sewer presently runs, to have the City's rights in said sanitary sewer clearly specified and made a matter of record by recording a formal easement. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: SECTION 1: That the Council does hereby accept an easement from Spartico an Ann DiBenedetto for the maintainence, construction and operation of a sanitary sewer system over and on the property described therein and more fully described in the in the easement which is attached hereto and made a part hereof as though fully rewritten herein and marked Exhibit "A". SECTION 2: That the engineering department of the City of North Olmste is hereby authorized to cause said easement to be recorded in the office of the Cuyahoga County Recorder.
