<br /> <br />The CITY OF WESTLAKE agrees, that should the tap in fees for North <br />Olmsted residents be increased above the fees in effect at the time of <br />entering into this AGREEMENT then the tap in fees paid to North Olmsted <br />by the CITY OF WESTLAKE shall be increased to the same amount. The <br />CITY OF WESTLAKE, agrees, that should it become necessary to increase <br />the Quarterly sewer charges for North Olmsted Residents above the rates <br />in effect at the time of .entering into this AGREEMENT, then the Quarterl <br />payments by the CITY OF WESTLAKE shall be increased correspondingly. <br />CITY OF WESTLAKE agrees, that should it become necessary to increase <br />property tax millage which is designated for wastewater handling and <br />treatment in North Olmsted above the millage in effect at the time of <br />entering into this AGREEMENT, then the Quarterly sewer payments by the <br />CITY OF WESTLAKE shall be increased by an amount expressed in dollars <br />and given by the formula ( Increase in North Olmsted Millage) (1.,750) <br />(Reading of master flow meter in thousands of cubic feet) , <br />Section 5. The CITY OF WESTLAKE agrees to pay Quarterly to the <br />CITY OF NORTH OLMSTED rates and charges which are Two Hundred Percent <br />(200°o above the rates and charges specified in Section 4 for each <br />Quarter in which the measurements made by the CITY OF NORTH OLMSTED <br />using the master flow meter installation and the sampling manhole show <br />the average flow rate, or the average sewage composition, to lie beyond <br />the limits specified in Section 1, item (a) through (d) . <br />Section 6. It is agreed the meter shall be read by the CITY OF <br />NORTH OLMSTED on or about the last day of each Quarter and the charge <br />shall be invoiced by the CITY OF NORTH OLMSTED to the CITY OF WESTLAKE <br />with the provisions of Section 4 hereof during the first five days of <br />the next succeeding month, and are due and payable without penalty <br />within fifteen days (15) thereafter. Should the invoice remain unpaid <br />for a period of s ixty days (60) , the CITY OF NORTH OLMSTED shall f orth- <br />with cease to deliver the "Services't as described herein by blocking <br />the flow from the CITY OF WESTLAKE to the CITY OF NORTH OLMSTED at the <br />sampling manhole. <br />Page 4 <br />
