Saringer <br />AN ORDINANCE A~~NI)INr SECTION 10 of <br />Ordinance No. 75-195 entitled "An <br />Ordinance amending Ordinance No. 74-166 <br />entitled An Ordinance to provide for proper <br />grading of land to provide for the drainage <br />of surface water within the City of North <br />Olmsted", as amended, adopted on September <br />16, 1975, as amended. <br />WHEREAS, it has been determined that the gradinq deposits <br />established in Section 10 of Ordinance 75-195 are insufficient due <br />to the present econamRic conditions, and <br />WHEREAS, it is the desire of this Council to establish new <br />grading deposits for commercial and multi-family developments. <br />NOW, THE_REE'ORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY <br />OF NORTH OLM.STED, COUNTY OF CUYAHOCzA AND STATE OF OHIO: <br />SECTION l: That Section 10 of Ordinance 75-195 adopted on <br />September 16, 1975, which reads as follows: <br />"Grades on dedicated Streets within the City of North Olmsted <br />SECTION 10: That on a dedicated street within the City of <br />North Olmsted no r~erson, firm or corporation shall be issued a <br />building permit for the construction of any structure until a <br />$500.00 cash deposit is paid to the Building Commissioner to <br />cover administrative costs, costs of checking grades and drainage <br />of surface water. The balance of said cash deposit shall be <br />refunded upon compliance with the terms of this ordinance after <br />deducting therefrom any costs and expenses incurred by the City, <br />as a result of work done by the City Engineer. <br />In cases involving commercial or multi-family property, the <br />City may require a deposit greater than the $500.00 to guarantee <br />such compliance. The amount thereof shall be determined by the <br />City Engineer, which determination shall be based upon the estimated <br />cost of performing such drainage work. <br />If the aforesaid work is not done within thirty (30) days <br />from the time of the sending of_ written notice by the City of <br />North Olmsted, the City may do the work and the aforesaid cash <br />deposit shall be applied to the cost of the City doing the afore- <br />said grading and any funds which are in excess of the City's cost <br />of grading shall be returned to the person making the deposit as <br />aforesaid, and further, any deficiency in funds between the deposit <br />and the cost of the City doing the grading, shall became a lien upon <br />the lands and shall be certified to the Auditor of Cuyahoga County <br />for entering upon the tax duplicate and collection as other taxes <br />and sahll be returned by the Auditor of Cuyahoga County to the City <br />for deposit in the General Fund of the City of North Olmsted." <br />
