The balance of said cash deposit shall be refunded upon <br />compliance with the terms of this ordinance after deducting there- <br />from any costs and expenses incurred by the City as a result of work <br />done by the City Engineer. <br />The following are Engineering inspection and grading deposits <br />for commercial (including multi-family housing) developments: <br />Less than 1 acre $1500 <br />1 to 3 acres $2500 <br />3 to 5 acres $4000 <br />Over 5 acres $6000 <br />tilThen engineering time charges have reduced the account <br />balance below 50 percent of the listed amounts, the developer shall, <br />upon notification, deposit the additional amount necessary to restore <br />the balance to .the amount listed above. <br />If the aforesaid work is not done within thirty (30) days from <br />the time of the sending of written notice by the City of North Olmsted, <br />the City may do the work and the aforesaid cash deposit shall be <br />applied to the cost of the City doing the aforesaid grading and any <br />funds which are in excess of the City's cost of grading shall be <br />returned to the person making the deposit as aforesaid, and further, <br />any deficiency in funds between the deposit and the cost of the City <br />doing the grading, shall become a lien upon the lands and shall be <br />certified to the Auditor of Cuyahoga County for entering upon the tax <br />duplicate and collection as other taxes and shall be returned by the <br />Auditor of Cuyahoga County to the City for deposit in the General <br />Fund of the City of North Olmsted." <br />SECTION 2: That Section 10 of Ordinance No. 75-195. adopted <br />on sept. f6, 197 and any other ordinance or parts of ordinances in <br />conflict herewith are hereby repealed. <br />SECTION 3: That this Ordinance shall take effect and be in <br />force from an after the earliest period allowed by law. <br />PASSED : ~~~c,~...~ /, l ~ 7 f <br />ATTEST: <br />Nora T.
