<br />FOR AND IN CONSIDERATION OF TEiE SUtt OF C"1~ DOLLAR paid by the City of North
<br />Olmsted, Ohio, the receipt of which is hereY;y aci:rowledged, the undersigned
<br />Donald F. Gates and Wanda H. Gatcs, Husband and Wife
<br />do hereby grant unto the City of North Olmsted, Ohio, an easement over and through
<br />tha following described lands, of which said grantor(s) warrant they are the Owners
<br />in fee simple, situated in the City of North Olmsted, County of Cuyahoga .and State
<br />of Ohio, and identified by Permanent Parcel'No. __ 232-27-33 ,
<br />said premises having been acquired by deed dated March 1955 ,
<br />and recorded in Volume 8255 Page 73
<br />of the Cuyahoga County Record of Deeds.
<br />and known as being Sublot No. 57 in the S. H. Kleinman Realty Corxpa.ny~s
<br />Westwood Subdivision of part of Original Dover Township Lot No. 6, as
<br />shown by the recorded plat in Volume 53 of Maps, Page 22 or Cuyahoga
<br />County Reeords, and being 55. 3 feet front on the easterly side or
<br />Silverdale Road (~0 feet xide~, 195.56 reef deep on the southerly line,
<br />198.08 feet deep on the northerly line nea,sured rroa the center line or
<br />Silverdale Road, and 55.39 feet wide in the rear, as appears by said
<br />plat, be the same ffiore or less, but subject to ail legal highways.
<br />The above easement is granted for the purpose of constructing, maintaining and
<br />operating a storm drain, together with the necessary manholes, for the transportation
<br />of surface water with the right of unimpaired access to said storm drain the rights
<br />of ingress and egress, on, over and through 's aid land for all purposes necessary and
<br />incident to the construction, operation and maintenance and from time, to time, alter,
<br />repair, or remove the same.
<br />The Grantor(s) herein reserve the right to fully use and enjoy said premises
<br />for all purposes consistent with the full use and enjoyment by the grantee of the
<br />easement herein granted. The construction of structures as defined in the Gxantees
<br />Building Code, except public utilities, is prohibited directly over the storm drain.
<br />Grantee shall have the right to change the size of its storm drain, the damages,
<br />if any, in making such change to be paid by the grantee.
<br />After the storm drain is constructed in the above described premises, the
<br />grantee agrees to return the surface of the ground to its original elevation.
<br />The rights herein granted may be assigned in whole or in part, and the terms,
<br />conditions and provisions thereof shall extend to and be binding upon the heirs,
<br />executors, administrators, personal representatives, successors and assigns, of the
<br />parties hereto.
