<br />FOR AND IN COtJSIDERATION OF T}~lE SUtI OF C`I°_ DOLLAR paid by the City of North
<br />Olmsted, Ohio, the receipt of which is hereby ac):rowledged, the undersigned
<br />Donald F. Gates gad Wanda H. Gates, Husband and Wile
<br />do hereby grant unto the City of North O]•msted, Ohio, an easement over and through
<br />tho following described lands, of which said grantor(s) warrant they are the Owners
<br />in fee simple, situated in the City of North Olmsted Count of Cuyahoga and State
<br />of -Ohio, and identified by Permanent Parcel 'No. 2~~-27-~~ ,
<br />said premises having been acquired by deed dated AuR. 5, 1975 ,
<br />and recorded in Volume l~$Sq Page g1}~
<br />of the Cuyahoga County Record of Deeds.
<br />Situated is the City or North Olmsted, County of Cuyahoga and Ststte of
<br />Ohio and known as being Sublot No. 2 in a re-Subdivision or part of the
<br />Original Dover Township Lot No. 6 as shows by the recorded plat in
<br />Volune 188 of Maps, Page 1 of CuyaY~oga County Records gad being 54.0
<br />feet front on the Fasteriy side or Silvcrdale Road t~0 feet wide and
<br />extending back 200.}5 feet deep on the Northerly iine, 198.08 feet
<br />deep on the Soutlaeriy line, as neaaured iron the center lint of
<br />Silverdale Road and r~avi~ag a rcar iine of 54. ~6 feet, as appears by
<br />said plat, be the sane port or lcss, but subject to all icgal highways.
<br />The above easement is granted for the purpose of constructing, maintaining and
<br />operating a storm drain, together with the necessary manholes, for the transportation
<br />of surface water iti~ith the right of unimpaired access to said storm drain the rights
<br />of ingress and egress, on, over and through said land for all purposes necessary and
<br />incident to the construction, operation and maintenance and from time, to time, alter,
<br />repair, or remove the same.
<br />The Grantor(s) herein reserve the right to fully use and enjoy said premises
<br />for all purposes consistent with the full use and enjoyment by the grantee of the
<br />easement herein granted. The construction of structures as defined in the Grantees
<br />Building Code, excep!G public utilities, is prohibited directly over the storm drain.
<br />Grantee shall have the right to change the size of its storm drain, the damages,
<br />if any, in making such change to be paid by the grantee.
<br />After the storm drain is constructed in the above described premises, the
<br />grantee agrees to return the surface of the ground to its original elevation.
<br />The rights herein granted may be assigned in whole or in part, and the terms,
<br />conditions and provisions thereof shall extend to and be binding upon the heirs,
<br />executors, administrators, personal representatives, successors and assigns, of the
<br />parties hereto.
